Walmart, CVS, Albertsons settlement overview:

New Mexico has reached $189 million in settlements with Walmart, Albertsons and CVS to end claims the three pharmacy chains exacerbated the opioid epidemic in the state.

New Mexico Attorney General Hector Balderas announced Dec. 20 that his office had resolved its opioid litigation against retail pharmacy chain operators Walmart, CVS and Albertsons in statewide deals that will deliver more than $132 million to the state and local communities to fund opioid abatement efforts, after attorney fees and costs.

“I’m incredibly proud of the extraordinary work of my team in securing this historic settlement, and it is imperative that these funds are invested in treatment services to begin the healing in our communities,” Balderas said.

New Mexico reaches multiple settlements around opioid crisis

When combined with previously announced settlements obtained from other manufacturers, distributors and retailers, Balderas said, his office has obtained more than $368 million in opioid abatement funding for the state and its communities in the past year. 

He also wrapped up a two-month-long trial against Walgreens in October, and a decision is expected from the court in that case in the coming weeks, the statement said.

Drug manufacturers Teva and Allergan, along with drug distributor Anda, are scheduled for trial in New Mexico’s opioid litigation in March 2023.

The announcement also comes weeks after Kroger agreed to pay $85 million to settle claims it also exacerbated the opioid crisis in New Mexico.

Walmart is contributing the majority of the latest settlement, with a total $150 million payment, in which $56.7 million will go to the state and participating local governments and $46 million to the state’s Consumer Settlement Fund, with $45 million to attorney fees and $1.8 million to other litigation costs.

Albertsons will pay $20 million, with $8.2 million going to the state and local governments, $6.7 million to the Consumer Settlement Fund, $4.5 million to attorney fees and $500,000 for litigation costs.

CVS has agreed to pay $19 million, with $7.4 million for the state and local governments, $6.5 million for the Consumer Settlement fund, $4.3 million for attorney fees and $150,000 for litigation costs.
