Vaginal Mesh Victim Sues Over Nightmarish Ordeal
By Jessica Tyner
Vaginal mesh implants are part of a family of medical devices that are supposed to treat stress incontinence and pelvic organ prolapse (POP). They do, but sometimes with devastating side effects. Leslie Collins is one of the most recent victims, and she filed a vaginal mesh lawsuit on August 23, 2013 against seven companies she says negligently sold defective transvaginal mesh implants that severely injured her.
A resident of Arizona, Collins is suing Boston Scientific Corporation, American Medical Systems, Johnson & Johnson, Ethicon, C.R. Bard, Sofradim Production SAS, Tissue Science Laboratories Limited — all companies connected to the design, manufacture and distribution of a faulty transvaginal mesh device that was implanted in Collins, which she and her doctors believed to be safe. Other companies targeted in vaginal mesh lawsuits include Mentor Worldwide LLC and Coloplast Corp. Unlike other vaginal mesh victims, Collins didn’t have just one bad experience — she had a roster of them. Her experience with a number of defective devices is mind blowing.
Collins is suing the numerous companies for the allegedly defective Uphold Vaginal Support System, Pinnacle Pelvic Floor Repair Kit, Advantage Transvaginal Mid-Urethral Sling System, Advantage Fit System, Lynx Suprapubic Mid-Urethral Sling System, Obtryx Transobturator Mid-Urethral Sling System, Prefyx PPS System, Solyx SIS System, and other eligible devices.
A Woman’s Vaginal Mesh Nightmare
Collins began her vaginal mesh nightmare in 2010, although her complaint doesn’t detail the doctor or location of her procedures. However, generally this is an outpatient procedure. There are checkups immediately following the implantation of the transvaginal mesh, but if everything seems “good to go,” patients are generally considered in a good place. What doctors and patients weren’t told is that vaginal mesh devices, which are made of metal, can chew into nearby soft tissue and organs. Similar to chicken wire, the surrounding tissue is a haven for these sharp devices.
One of the biggest issues is that women aren’t always immediately aware of the damage. Some women experience acute pain, while others feel nothing at all. Pain isn’t necessarily indicative of the worst cases.
In some instances, transvaginal mesh injuries can cause permanent scarring, infertility, and lifelong pain. Divorces have been caused by these devices since some women can never again enjoy sex, or even bear it without immense pain. It’s easy for this soft tissue to scar, and nearly impossible to correct.
Removing the mesh once it’s become embedded is challenging at best. Some women report numerous attempts at vaginal mesh removal, and even then there are often pieces left behind. These surgeries aren’t just painful and very invasive, but also expensive. There are medical bills to pay as well as economic losses since the women of course can’t work for a time following surgery.
In Collins’ case, she suing the companies for negligence, design defect, manufacturing defect, failure to warn, and breach of warranty. Had she been married and her spouse opted to join the lawsuit, the spouse could also sue for loss of consortium.
Discovery rule, tolling, and fraudulent concealment as well as punitive damages are also being sought. Collins will get a trial by jury and unfortunately joins the many other vaginal mesh sufferers in her quest for due compensation. Although there’s no real price for this kind of lifelong pain, it’s a start.
Preparing for Battle
The many women who report being harmed from vaginal mesh implants are strong to begin with. They’ve endured an incredible journey, and are on a quest to get the compensation they so truly deserve. There’s no denying that these devices are harmful judging from the sheer number of complaints.
Collins is one of many women who learned the hard way just what the complications of a vaginal mesh procedure could include. Her lawsuit doesn’t just provide a route for compensation; it also helps warn other women of the risks. There are doubtless more women who are victims who have yet to come forward, but stories like Collins’ might help bring them to the surface.
