Stryker Hip Recall Lawsuit Alleges Multiple Hip Surgery Problems
By John Curran
Ryan Tatsch of Colorado says that as a result of complications caused by a defective Stryker hip implant, he suffered and required two hip replacement revision surgeries, according to a new lawsuit filed July 23.
Tatsch says in his Stryker hip lawsuit that he first received the allegedly defective device during a hip replacement surgery on July 28, 2011. Less than two years later, he needed a follow-up procedure to remove the faulty Stryker Rejuvenate hip and suffered additional injuries as a result. In addition to these painful hip replacement complications, he has lost the ability to work to the same degree prior to the injuries.
His Stryker hip recall lawyer notes in the complaint that “the particular titanium alloy [used in the Stryker Rejuvenate] has been tested and proven by Stryker to resist the effects of corrosion and fretting.” However, the coating and alloys used at the artificial hip joint did not actually limit the erosion of materials that had been scientifically demonstrated in the 1980s, which led to a voluntary recall of Stryker hip implants on July 6, 2012.
That Stryker hip recall cited instances of corrosion and fretting that the company had allegedly warranted wouldn’t happen because of the design of the Stryker Rejuvenate metal on metal hip implant. The deterioration of the devices can cause metallosis side effects, which include nervous system damage, as well as inflammation that can lead to the hip implant dislodging. Many plaintiffs have reported the need for hip revision surgery and occasionally permanent disfigurement.
Tatsch is alleging counts of design and manufacturing defect, failure to warn, negligence, and breach of express and implied warranties in the Stryker hip lawsuit.
His Stryker Hip Recall Lawsuit is Ryan L. Tatsch v. Stryker Corporation, Case No. 13-cv-1424, U.S. District Court, Eastern District of Missouri.
