Nature Made extra strength vitamin C class action lawsuits overview: 

  • Who: David Wittman and Maria Mendez Whitaker filed separate class action lawsuits against Pharmavite LLC. 
  • Why: Wittman and Whitaker claim separately that Pharmavite deceptively markets certain of its Nature Made brand Chewable Vitamin C products as being “Extra Strength.” 
  • Where: The class action lawsuits were filed separately in New York and California federal court. 

Pharmavite LLC falsely and deceptively markets certain of its Nature Made brand Chewable Vitamin C products as being “Extra Strength,” a pair of class action lawsuits allege.

Plaintiffs David Wittman and Maria Mendez Whitaker separately claim that Pharmavite’s Nature Made brand Extra Strength Chewable Vitamin C products don’t contain a higher dose of Vitamin C than their regular strength versions. 

“Unbeknownst to consumers, the Products do not have a higher dose of Vitamin C per tablet than the Regular Strength Products,” the Nature Made class actions state. 

Wittman and Whitaker both argue that consumers have “reasonably relied” on Pharmavite’s “deceptive labeling” and that they paid a premium price for the extra strength vitamin C products on account of them. 

Nature Made class action alleges company violates laws in California, New York 

Wittman wants to represent a nationwide class and California subclass of consumers who purchased Nature Made brand Extra Strength Chewable Vitamin C products for personal, family or household consumption. 

He claims Pharmavite is guilty of unjust enrichment and in violation of New York General Business Law

Whitaker claims Pharmavite is guilty of unjust enrichment and in violation of California’s False Advertising Law, Unfair Competition Law and Consumers Legal Remedies Act.

The plaintiffs both demand a jury trial while Wittman requests declaratory relief and statutory and punitive damages while Whitaker requests injunctive and declaratory relief along with economic, monetary, actual, consequential and compensatory damage.

A separate class action lawsuit filed against Pharmavite earlier this year claims the company mislabels its Nature Made brand fruit flavored gummies by saying they don’t contain artificial flavors
