Colorado Woman’s Pelvic Mesh Lawsuit Joins C.R. Bard MDL

By Robert J. Boumis

Pelvic Mesh LawsuitBeverly Major of Colorado is suing C.R. Bard Inc. over complications suffered from a pelvic mesh implant. Her case joins existing multidistrict litigation over pelvic mesh complications.

Multidistrict litigation or MDL is a type of mass tort, similar to a class action lawsuit. In both MDLs and class action lawsuits, a group of plaintiffs sues a defendant over similar charges. However, in a class action lawsuit, all of the allegedly injured parties are represented by a single lawyer or team of lawyers, while in MDLs the plaintiffs have their own legal representation.

Major alleges that a pelvic mesh implant, specifically the Align Urethral Support System, was defective and led to complications. Pelvic mesh is a type of surgical mesh, a support structure designed to bolster internal organs when the muscles that normally support them are weakened from conditions like pelvic organ prolapse or stress urinary incontinence. Since pelvic mesh was based on existing surgical mesh technologies, it was able to bypass some of the steps of clinical testing required for medical technology.

However, patients have reported a number of serious, painful vaginal mesh complications, including erosion, embedment and issues with the anchoring points.

In erosion, the mesh actually cuts its way through the very tissue it was designed to protect, abrading through soft tissues of the pelvic organs. In embedment, the body tries to encapsulate the mesh in its own tissue, growing around the implant. In these cases, the patient often suffers serious pain, and surgeons may experience great difficulties in removing the mesh.

Additionally, many types of pelvic mesh use areas near the spine for anchoring points. Since this tissue is rich in important nerve endings, these anchor points could cause serious problems, like damaging the nerves that control and monitor the lower body. This can cause pain, numbness and paralysis in the lower body. The damage from these pelvic mesh complications can cause pain, sterility and organ damage, and often requires surgical intervention to remove the offending implant.

Major filed her vaginal mesh lawsuit directly into the C.R. Bard MDL, called In Re: C.R. Bard Inc., Pelvic System Product Liability Litigation, MDL No. 2187, in the U.S. District Court for the Southern District of West Virginia.
