Duck BoatA Montana woman has received a $4 million verdict for personal injury compensation after she was injured in a duck boat crash almost four years ago.

Her lawsuit is one of a number of lawsuits filed against Ride the Ducks International and the Seattle Ducks, operators of the vehicle that was involved in the crash. Like the Montana woman, many other victims claimed that the companies’ negligence caused the crash.

A Duck boat is the colloquial name for the DUKW, a “six-wheel-drive amphibious modification” of a type of truck used by the United States military in World War II and the Korean War. Now, they have become tourist attractions, and companies like Ride the Ducks offer tours aboard the vehicles. 

According to the news source KSL, while on a tour in September 2015, the axle of one vehicle owned by Ride the Ducks International and Seattle Ducks snapped, which caused it to crash into an oncoming college tour bus. 

Allegedly, five college students and dozens of people were injured in the accident. One of the injured people was Rebecca Rhodes West, of Billings, Montana. She received a $4 million verdict from a jury to compensate for the physical and emotional injuries she suffered in the crash.

The jury determined that 60 percent of the liability in the crash lay with Ride the Ducks International, and 40 percent with the Seattle Ducks. The jury determined that both companies should be held responsible for the issues that caused the crash. Reportedly, the company manufactured the vehicle with a defective axle and did not replace it with an effective one.

West says that during the crash, she was thrown from the duck boat. Allegedly, she hit the pavement, and as a result, broke her foot, shattered her tooth, and developed a hematoma on her hip. Allegedly, her medical problems continue to plague her, even four years later.

She says that she continues to require a walking boot for her broken foot, and claims that she will never be able to walk the same. Allegedly, she also developed chronic nerve pain as a result of the duck boat accident.

In addition to physical injuries, she says that she suffered financial injuries in the form of medical bills and missed work due to injury. She also says that she suffered emotional injury, and now goes to concealing for nightmares she suffers as a result of the traumatic accident.

In April, The Seattle Times reported that the two companies reached a $7 million dollar settlement with another victim in the same Duck boat crash.

In other lawsuits over the same crash, the companies withdrew an attempt to appeal a decision that gave a $123 million personal injury compensation verdict to 40 plaintiffs, who each received between $40,000 and $25 million in personal injury compensation for the injuries they allegedly suffered in the duck boat crash.
