A settlement website is live for a Mercedes class action deal that will cover around 2.5 million vehicles allegedly equipped with moldy heating, ventilating and air conditioning (HVAC) systems.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

Plaintiffs asked the court to preliminarily approve the Mercedes class action settlement in December 2019.

Under the terms of the proposed settlement, Class Members will include current and former owners or lessees of the following Mercedes vehicles: Mercedes-Benz 2008-19 C-Class, 2010-15 GLK-Class, 2012-17 CLS-Class, 2010-19 E-Class, 2015-19 GLA-Class, 2013-16 GL-Class, 2016-19 GLE-Class, 2017-19 GLS-Class, 2012-15 M-Class and 2016-19 GLC-Class.

If granted final approval, the Mercedes class action settlement will provide compensation for owners and leasees of these vehicles for previous HVAC repairs. The company will reportedly pay an unlimited amount to compensate Mercedes drivers for past repairs by an authorized service provider.

Although the payments have no limit, the settlement limits repairs done by an independent service provider to a maximum of $300 per repair. Only $900 in independent service provider repairs will be covered per vehicle.

In addition to past repairs compensation, the Mercedes class action settlement will provide 100 percent coverage for future repairs, if the repairs fall within the vehicle’s warranty coverage period which is four years of the in-service date, or 50,000 miles – whichever is earliest.

Seventy percent coverage will be provided for repairs within the earlier of eight years from the in-service date or 100,000 miles. Fifty percent coverage will be provided for repairs within the earlier of 10 years from the in-service date or 125,000 miles.

In order to receive compensation for past or future repairs, settlement Class Members will need to submit a valid claim form online or through mail. Claim forms will need to be supported with documentation of repairs.

“Class Members can receive Qualified Future Repairs by bringing their Vehicle to an Authorized Service Center, which will determine eligibility and perform the repairs,” the Mercedes class action settlement agreement notes.

“Dispute resolution is available for Class Members who dispute their reimbursements or believe they are wrongfully denied coverage.”

The settlement is currently pending preliminary approval. If the terms are granted initial approval, the settlement will likely proceed to the claims process. If the settlement is rejected, the terms may need to be changed in order to move forward.

    I don’t think I submitted my claim in time but my 2013 glk has this issue. What should I expect when I take it back for this recurring issue. It’s barely been 2 years since I paid $250 to fix it in 2019.

    I have a Mercedes a class and had the filters replaced but still smell a very moldy odor, I have experienced headaches and stuffy nose symptoms and I am shocked being that this is a brand new luxury car.

    I own a 2014 E350 and I have smelled an odor on and off for over a year I bought it. I have changed the filter and the odor comes back. I have used air freshener and Lysol and it works as long as I freshen it up regularly. I am non smoker, and no one smokes in my car. Please put me in for this claim.
