The GEICO total loss class action settlement resolves claims that the insurance company violated their contracts by failing to fully pay total loss settlements to consumers.

The company reportedly didn’t compensate policyholders for title transfer fees and license plate transfer fees, which the drivers claim is part of the actual cash value.

A federal judge determined in the case that these fees should be included in the actual cash value and that GEICO needed to face the claims against them. Based on this, the court found GEICO liable in a summary judgement ruling and ordered the company to pay consumers $79.35 each.

“Courts have found that replacement cost includes items such as a contractor’s overhead and profit, sales tax, and fees where it is ‘reasonably likely’ that the insured would incur these costs if he or she repaired or replaced the property,” Judge Paul G. Byron determined.

Following the summary judgment against them, GEICO has agreed to settle the drivers’ claims by paying into a $27 million GEICO total loss class action settlement.

The settlement benefits the following consumers:

  • Florida residents who were insured by Government Employees Insurance Company or GEICO General Insurance Company for an owned (not leased) vehicle and were awarded a total loss claim payment between May 17, 2012 and April 4, 2019;
  • Florida residents who were insured by GEICO Indemnity Company for an owned (not leased) vehicle and were awarded a total loss claim payment between Oct. 10, 2012 and April 4, 2019.

Under the GEICO total loss class action settlement, Class Members will be able to recover full payments owed to them. The payments are expected to be $79.85 – covering $75.25 in title transfer fees, $4.10 in tag transfer fees, and $0.50 in branch fees.

In the GEICO total loss class action settlement’s preliminary approval motion, the plaintiffs note that these payments will be $0.50 more than the payments which would have resulted from the summary judgement order due to the inclusion of branch fees.

In order to receive compensation from the GEICO total loss class action settlement, Class Members need to file a valid Claim Form by July 21, 2020. They will reportedly have until May 22, 2020 to opt out of the settlement or object to its terms.

    8/22 I was rear ended and pushed into the truck in front of me. I had minimal damage and the car was drivable. GEICO deemed my 2011 BMW that was paid off a total loss. I stated I would take car back and have it fixed with my mechanic as it was missing the back number and the trucks hitch placed a hole in my hood. I was told that once they deemed my car a total loss no other insurance company would insure me. The repair was 5k from adjuster and value of the car is between16-21k I was paid 10k. On 11-11-22 a deer struck my sons car with 12k worth of damage for a car that is only worth 2500 and GEICO paid to have it fixed then another 7k in electric work bc it sat outside at collision center with busted windows.

    I was also insured by Geico at the time of my accident that resulted in a total loss 09/2020. Given information in regard to the “Value “of what my “Full Coverage” policy intitled, by the Adjuster that gave less of all values that did not add up. I filled out a claim in regard to this Lawsuit against Geico, back in 2021.

    Please call me I am currently in with GEICO who illegally gave my car to Copart I still have not got my car back or a Total Loss Check I have no other party on my insurance policy I am going through this right now with GEICO they never told me what was going on y claim was filed in nov 2023 my car is still at Copart they will not release the car I signed a release to have the car brought to Hyundai in Daytona beach it never got there J Perez from Geico keeps emailing me a document that is unnecessary even thou she knows I opted out of E-documents they gave my policy information to a third party information that is confidential GEICO is i this situation doing alot of things that are its a mess please call me

    Please please enter my name in lawsuits not only did Geico total my car out when I rented a card and got into a accident I was not paid for the rental car damages only because the budget rent a car did not provide them with a receipt so they charged my card 3700 even after I provided them with a receipt they are refusing to pay for damages how ever they were quick to put a accident on my record please add me imdareo@gmail.com
