woman drinking grove square coffeeA website has been established to inform consumers of their rights and options under a class action lawsuit that accuses Grove Square Coffee of using instant grounds in their single Keurig-style cups.

The website includes information about the class action lawsuit, frequently asked questions, court documents, and more.

On the website, consumers can register their name and contact information with the settlement administrator in order to receive a formal notice when more information is available.

Plaintiffs in the Grove Square class action claimed that the company deceived consumers with their single serve K-cup products. Whereas typical K-cups provide freshly brewed coffee from grounds when used in a Keurig machine, Grove Square K-cups allegedly dispense lower quality instant coffee.

According to the K-cup class action, Grove Square intentionally made their products in a deceptive manner and marketed them “to look exactly like the product the consumer wanted.” Grove Square Coffee single cups were allegedly a lower quality product masquerading as typical, more expensive K-cups.

In May 2019, plaintiffs and Grove Square reached a class action settlement to resolve claims. The exact details of the settlement are not known at this time, but more information will be found on the Grove Square class action website as it becomes available.

According to the class action lawsuit website, eligible Class Members include consumers who purchased Grove Square Coffee products in Alabama, California, Illinois, New Jersey, New York, North Carolina, South Carolina, and Tennessee since September 2010.

If the settlement is approved by the court, it will resolve more than eight years of litigation between the plaintiffs and Grove Square.

In 2013, the Grove Square class action lawsuit was actually dismissed after a federal judge determined that plaintiff Linda Suchanek failed to show how she was injured or deceived by the alleged false advertising. However, this dismissal was later reversed in the Seventh Circuit and the Grove Square class action was revived.

In the following litigation, both sides did their best to undermine each other’s efforts to bring expert witnesses. Both Suchanek and Grove Square failed in this attempt, and the case moved forward.

In the Grove Square class action’s trial brief, the coffee company argued that their packaging did not contain false information in its original and modified forms.

The original version of the packaging reportedly included statements that the coffee was “soluble & microground” while the modified packaging included statements that the coffee was “instant and microground.”

The Grove Square Coffee Single Cup Class Action Lawsuit is Suchanek, et al. v. Sturm Foods Inc.et al., Case No. 3:11-cv-00565, in the U.S. District Court for the Southern District of Illinois.
