Prevagen Brain Health Supplement Website is Active

A website for a Prevagen class action lawsuit is now live, containing information about key dates and court documents.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

Class Members may belong to the California Unfair Competition Law (UCL) Class or the California Consumers Legal Remedies Act (CLRA) Class.

The UCL Class includes “all California consumers who, within the time period of January 21, 2012 to May 7, 2019, purchased Prevagen Regular Strength, Prevagen Extra Strength, or Prevagen Mixed Berry Chewable.”

The CLRA Class includes “all California consumers who, within the time period of January 21, 2011 to May 7, 2019, purchased Prevagen Regular Strength, Prevagen Extra Strength, or Prevagen Mixed Berry Chewable.”

If Class Members wish to stay in the Classes and await the outcome, they are not required to do anything. Depending on the outcome, future action may be required to collect money from the Prevagen class action lawsuit. The trial for the Prevagen class action lawsuit is currently scheduled for Jan. 6, 2020.

If Class Members are not interested in participating in the Prevagen class action lawsuit, they must ask to be excluded from the Classes by Sept. 2, 2019.

To be excluded, Class Members need to send a letter or email to the notice administrator containing their name, address, telephone number, email address, and signature.

Prevagen brain supplements are reportedly represented as “clinically tested” supplements that “improve memory” and “support healthy brain function, sharper mind, and clearer thinking.” Despite these representations, the supplements allegedly fail to work.

Plaintiff Phillip Racies filed a class action lawsuit against Quincy Bioscience LLC in February 2015, claiming that the company knowingly deceived customers into believing that their supplements were effective.

Racies claimed that Prevagen’s only active ingredient, apoaequorin, cannot work effectively in the supplement because it is “completely destroyed” in the digestive system. He also argued that the clinical trials referenced by Quincy Bioscience are “so seriously flawed that they demonstrate nothing regarding Prevagen.”

“The only reason a consumer would purchase Prevagen is to obtain the advertised brain function and memory benefits, which it does not provide,” Racies argued in his Prevagen class action lawsuit. “Prevagen is a singular purpose product – its only purported benefit is to enhance brain function and memory which it does not and cannot do.”

Quincy Bioscience faces similar class action claims in the District of New Jersey. In this class action lawsuit, plaintiff Elaine Spath argues that she would not have purchased the Prevagen brain function supplements if she knew that the product had not been clinically tested.
