Nissan will pay $277.7 million as part of a settlement resolving class action lawsuit claims certain vehicles were equipped with a defective continuously variable transmission, or CVT.

The settlement agreement benefits a nationwide Class of owners and lessees of the following vehicle models:

  • 2014 to 2018 Nissan Rogue
  • 2015 to 2018 Nissan Pathfinder
  • 2015 to 2018 Infiniti QX60

Nissan owns both the Nissan and Infiniti automotive brands. Vehicles from these brands are sold around the country but, according to class action lawsuits, may not be as reliable as customers expect.

Plaintiffs in the Nissan transmission class action lawsuit contend their vehicles suffered from defects originating in the CVT. The CVTs used in Nissan Rogues and other vehicles allegedly cause poor transmission performance, shuddering and shaking, and even complete transmission failure.

The class action lawsuit accused Nissan of knowing about the CVT problem for years due to numerous complaints to the company and to the National Highway Transportation Safety Authority (NHTSA). Instead of taking action, Nissan allegedly failed to warn customers or fix the problem. 

Owners and lessees were allegedly forced to pay “exorbitant” costs to repair the CVTs. In some cases, transmissions allegedly needed several repairs.

Nissan has not admitted any wrongdoing but agreed to pay $277.7 million to resolve the claims.

All settlement Class Members are eligible for a new vehicle limited warranty extension under the Nissan transmission class action settlement deal. This benefit extends the warranty on Class vehicles by 24 months or 24,000 miles — whichever comes first. 

For Nissan vehicles, the original warranty covered 60 months or 60,000 miles. With the extension, the Nissan new vehicle limited warranty covers 84 months or 84,000 miles.

For Infinity vehicles, the original warranty covered 72 months or 72,000 miles. With the extension, the Infinity new vehicle limited warranty covers 96 months or 96,000 miles.

In addition to extending vehicle warranties, the Nissan CVT settlement provides cash reimbursement for owners or lessees who had to pay for transmission repairs out of pocket after their warranty expires. 

If the repairs fell within the new warranty time period, Class Members can collect up to $5,000. 

However, if the repairs occurred outside of the extended warranty period, consumers are not eligible for payment.

The deadline for exclusion and objection is Feb. 22, 2022. 

Although the Nissan transmission class action settlement deal was awarded preliminary approval on Oct. 13, 2021, the court still needs to make a final decision about the settlement’s fairness. The final approval hearing for the settlement is scheduled for March 21, 2022.

In order to receive repair reimbursement under the Nissan CVT class action lawsuit nsettlement, Class Members must submit a valid claim form by March 22, 2022, or 30 days after their qualifying transmission repair — whichever date is later.

Who’s Eligible

Nationwide Class of owners and lessees of the following vehicle models:

  • 2014 to 2018 Nissan Rogue
  • 2015 to 2018 Nissan Pathfinder
  • 2015 to 2018 Infiniti QX60

Up to $5,000

However, if the repairs occurred outside of the extended warranty period, consumers are not eligible for payment.

Proof of Purchase

If you have documentation showing the replacement or repair was to the transmission assembly (including torque converter and/or valve body) or automatic transmission control unit (ATCU) in your vehicle, please submit an original or true and correct copy of documentation created by an authorized Nissan or Infiniti dealer or other non-Nissan/Infiniti automotive repair facility at or around the time of the replacement or repair, that includes your vehicle’s VIN, proof you paid out of pocket in whole or in part for the replacement or repair, the amount you paid for the replacement or repair, the vehicle’s mileage at the time of replacement or repair, and the date of replacement or repair to your vehicle.If the replacement or repair was performed after the mileage and durational limits of the warranty extension as applicable to the vehicle, and you have documentation showing  an authorized Nissan or Infiniti dealer previously diagnosed and recommended replacement or repair to your transmission or ATCU when your vehicle was within the mileage and durational limits of the warranty extension, submit — in addition to the documentation requested above —  include an original or true and correct copy of documentation created by the authorized dealer at or near the time of the diagnosis and recommendation that includes the following information: the authorized Nissan or Infiniti dealer diagnosed and recommended a replacement or repair to the transmission assembly (including torque converter and/or valve body) or ATCU in your vehicle, your vehicle’s VIN, the vehicle’s mileage at the time of the dealer’s diagnosis and recommendation, and the date of the dealer’s diagnosis and recommendation.

    My 2015 Sentra had to have the CVT entirely replaced, wish I had done more research on these newer transmissions because every time I brought it in they told me nothing was wrong until the transmission gave out on me at 86,000 miles, lol, oh the irony. Good luck to everyone who qualified for this settlement, now we all know, no more CVTs lol.

      My 2017 Sentra was shuddering and shaking when I slowed down and turned corners. Taking off from a stop sign it would do it shifting to third gear. Now it sits in my yard with the transmission out cause I can’t afford 4000 to fix it. Plus I still owe$10,000 on the car.

    I have had these problems with my 2016 Sentra. I was riding in it when it lurched while my brother was driving, it went over a 4 inch median strip and has caused the transmission to leak profusely. On the plus side the lurching only seems to happen now when it is low on fluid (about every 3 days). Why is my Sentra not covered?

      Did you buy it from Nissan or a 3rd party and have you taken it in to Nissan to get a diagnostic? If you haven’t, take it in to a dealership, just in case the transmission does go out, then you paperwork that shows you brought it to them first and you can get them to pay the costs to fix it or maybe even take it back!
      But I don’t know why it doesn’t include your sentra, it should.

    Why doesn’t this apply to 2013 Rogues? Must have had same problem because my transmission blew and paid over $3000 to put in a new one in 2019☹️

    I have a 2017 Rouge. Transmission so far holding but keep in mind I only have 15000 miles on it . On the other hand my 2014 Sentra is another story . I had extended warranty which I paid for . Dealer allegedly replaced it because original one failed . Now I have the same issues with my second transmission and dealer won’t even touch it . My solution for the problem “ DON’T BUY ANOTHER NISSAN.

    I just got a diagnostic for my 2013 Nissan Rogue. Defective CVT transmission, Nissan USA only agreed to cover half the costs.

    I had my transmission done of the warranty dept by nissan dealer now my car in two week my transmission is not working I have 2015 Pathfinder I took back the nissan. Dealer to get it fix

    Nissan give consumers option for regular 6 speed auto transmission and manual transmission. Your engine are solid but CVT???
    Damage has been done! Return to what works.
