Lincare Holdings agreed to a $7.25 million settlement to resolve a class action lawsuit claiming it failed to protect consumers from a 2021 data breach.

The settlement benefits individuals whose personal information was stored by Lincare Holdings and potentially compromised in the September 2021 data breach.

The Lincare Holdings data breach occurred in September 2021 and allegedly compromised patients’ personal identifying information and protected health data. According to plaintiffs in the class action lawsuit, Lincare could have prevented the data breach by implementing reasonable cybersecurity measures to protect the information from hackers.

Lincare Holdings is a Linde company that provides in-home respiratory care and equipment. 

Lincare Holdings hasn’t admitted wrongdoing but agreed to a $7.25 million settlement to resolve the data breach class action lawsuit.

Under the terms of the settlement, class members who suffered from out-of-pocket losses as a result of the data breach can receive up to $5,000 in reimbursement for these losses. These payments include compensation for bank fees, communication expenses, credit fees, fraudulent charges, identity theft damages and up to four hours of lost time compensated at a rate of $20 per hour.

California class members can receive an additional $90 for potential statutory claims under California law.

All class members can receive one year of free Medical Shield services, which include health care insurance plan monitoring, medical record monitoring, provider monitoring, Medicare monitoring, HSA monitoring, dark web monitoring, $1 million in identity theft insurance, real-time authentication alerts, high-risk transaction monitoring, credit-freeze assistance and remediation services. 

Lincare Holdings also has agreed to implement certain security measures for at least one year to protect patients’ personally identifiable information.

The deadline for exclusion and objection is March 14, 2024.

The final approval hearing for the Lincare Holdings class action settlement is scheduled for June 12, 2024.

In order to receive settlement benefits, class members must submit a valid claim form by April 15, 2024.

Receipts for credit monitoring, professional invoices, lost time logs, postage receipts, bank statements, credit reports and other proof of loss.

    lincare is horriable, I have about 4 portable tanks since covid and tried to switch them and get more, Was told they couldnt refill them because people needed them during covid, where i actually have copd, and needed them. Long story short, I ended up buying a used condenser at a yard sale, i asked if it was stolen and they said no, Guess what sticker says on bottom LINCARE. Oh well i will never recomend their services anywhere

    Lincare since Xmas! Never called to explain, nothing.That why i say the weather so i dont leave home. Last yrin 2023 my son got me a ticket to go to Vegas for xmas. Of couse u have to use portable. They didnt do the paper work so had to pay $200 for 1 week from a comperitor.

    I returned all of the oxygen equipment I had back to Lincare in July 2023. My bill was paid and I don’t owe Lincare any money; but every month I receive a bill stating I owe Lincare $35.05.. I’ve called Lincare every month and talk to a customer service rep. The rep looks up my account states they see where all the equipment has been returned and my account is closed. Then next month I get another bill stating I still owe Lincare. This last month, in January, I received another bill stating if I don’t pay my “Past Due” bill my account will be put into collection. Once again I call Lincare and again the customer service rep stated my account is closed and not to worry.

    Does this bill statement harassment connected to the class action suit?

    That is nice to know because right now I going to some issues with my stamen they trying to charge me like $97.00 more and one mask the I never received.
