East Tennessee Children’s Hospital (ETCH) agreed to a $1.55 million class action lawsuit settlement to resolve claims that it failed to prevent a 2022 data breach.
The settlement benefits all individuals whose private information was compromised in the East Tennessee Children’s Hospital data breach in March 2022.
The data breach class action lawsuit claims East Tennessee Children’s Hospital should have taken reasonable measures to prevent a data breach. The hospital’s alleged failure to implement security measures and other protections led to the data breach, the plaintiffs contend.
East Tennessee Children’s Hospital is a 152-bed hospital in Knoxville, Tennessee.
ETCH hasn’t admitted any wrongdoing but agreed to a $1.55 million settlement to resolve the data breach class action lawsuit.
Under the terms of the ETCH settlement, class members can receive up to $500 for ordinary data breach losses, such as professional fees, credit expenses, communication charges, travel costs and up to five hours of lost time at a rate of $15 per hour.
Class members who experienced extraordinary losses resulting from fraud or identity theft following the data breach can receive up to $5,000 in compensation for these losses. The settlement only compensates documented extraordinary losses that have not been recovered through credit monitoring insurance and other avenues.
The deadline for exclusion and objection is Oct. 20, 2023.
The final approval hearing is scheduled for Dec. 12, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Feb. 17, 2024.
