DoorDash fees class action lawsuit overview: 

  • Who: A Maryland federal judge extended the discovery period for a class action lawsuit against DoorDash Inc. 
  • Why: Consumers claim DoorDash charges unlawful fees to its users, delivery drivers and restaurant merchants. 
  • Where: The class action lawsuit was filed in Maryland federal court. 

A federal judge in Maryland granted a motion to extend the discovery period for a class action lawsuit against DoorDash claiming the food delivery service charges unlawful fees. The deadline is now Feb. 16.

In a complaint filed against DoorDash last September, a group of consumers claim the company charges fees to its delivery drivers and restaurant merchants that cause consumers to “bear the unsettling burden of the increased cost.” 

“Because DoorDash’s hidden fees (which include hidden commission, marketing, sponsored listing and credit card transactions fees) reduce profit margins on food orders, restaurants must increase their prices,” the DoorDash class action states. 

The group of consumers claim DoorDash also charges users a variety of misleading and deceptive fees, including so-called “city” fees that “create the illusion for consumers that local governments impose these fees on orders.” 

DoorDash charges delivery fees despite not performing deliveries, class action claims

DoorDash charges its users a number of delivery fees despite the company allegedly not conducting the deliveries themselves, the DoorDash class action alleges. 

“DoorDash’s fees are deceptive, misleading and otherwise fraudulent. DoorDash promises services that it does not provide, including charging consumers a premium amount for deliveries that DoorDash does not perform,” the DoorDash class action states. 

Consumers want to represent a nationwide class of DoorDash users who were “inappropriately and illegally charged” by paying any combination of a delivery fee, express (or priority) delivery fee, extended range delivery fee, marketing fee or commission fee after placing an order on the DoorDash app or website. 

The class action lawsuit claims DoorDash is guilty of unjust enrichment, negligent misrepresentation, fraudulent concealment, fraud or deceit and violations of the Racketeer Influenced and Corrupt Organizations Act, among other things. 

The plaintiffs demand a jury trial and request declaratory and injunctive relief along with an award of monetary and treble damages for themselves and all class members. 

In JUly 2022, a consumer filed a separate class action lawsuit against DoorDash, arguing the company falsely advertises it charges no delivery fees despite adding fees in the prices of items purchased for delivery.

    I have paid more in fees than my actual food order when using door dash. In-addition, I have paid for my orders and no one delivered my orders. The drivers either felt my tip amount was enough one driver replied and others didn’t show up. I usually always tip very well. One time using door dash because I was very sick but needed to feed my son and I only had $2 to tip due to being very ill and missing work. No one showed up but I paid for my order. Door dash is a disgrace to the working family and is only interested in raising prices making the working people pay outrageous fees. Please ADD ME to this class action law suit. Thank you.

    Door dash has repeatedly added illegal fees and has charged for non deliveries that they refuse to refund. I have had multiple orders that they claim were delivered yet I never received. When they are notified they refuse to correct by either refunding or resenting. They are a total scam and are operating illegally by charging for services not rendered

    Doordash is the biggest scam to ever hit the USA, and when you confront them about pricing they claim no liability and put all blame on the restaurants. When in fact the fees that door dash charges these places is what causes the prices to be jacked up sometimes 50% from regular menu price. I’m so glad to see this lawsuit, doordash needs to be brought down off that high horse and pay for everything they’ve done wrong, I’ve said for years door dash is biggest scam ever

    I also am a delivery. Driver. And yes I also get two orders for the price of one. And not only that I also was told not to hand receipts over to customers. Also some times I will accept an order for like $10.00 and wen I finish the order it saids I received $8.00.. also the cash on demand orders like pizza hut for instance. The app will throw that order at 3.00 then I will pick up order and deliver it for like$ 26.00 or even $60.00 then wen I collect the cash they don’t credit me that 2.00 they deduct it off my next times dashing in over all I am not making any money for that order at all…

        YES I also deliver for for dash and I am told not to give the receipt to the customer from grocery stores because they raise the prices on items purchased by the customer.

          Also, I’ve been on so many deliveries that take me miles and miles to deliver to only get paid $2 which wouldn’t even pay for the cost of gas to get it there. And a lot of the time the navigation system they have takes me to a completely different destination and I have to figure out on my own where the address actually is and door dash does not reimburse me for the time or gas. Then it counts against me for being late. Or I go and pick up an order and its a scam when I go to deliver the people at the address never ordered and I have to return the order to the restaurant and don’t get paid for the time or gas I used
