Companies who do business with industrial gasses giant Praxair could be eligible to recover compensation based on a new investigation about price gouging.

Praxair provides industrial gases to companies worldwide, including those working in electronics, energy, laboratories, health care, refining, pulp and paper, glass, food and beverage, aerospace and aircraft, and additive manufacturing.

What Are the Allegations Against Praxair?

The primary allegation by customers is that Praxair prices are inflated because the company charges fees referred to as an energy charge, transportation charge or fuel charge.

According to consumers, this fee is designed to pass through fuel costs but instead amounts to a hidden profit unrelated to fuel costs.

Additionally, some customers have said that Praxair has locked them into prohibitive contracts before initiating unjustified price increases.

Praxair Class Action Lawsuit

A class action lawsuit has been filed against Praxair subsidiary NUCO2 LLC based on claims that the company is operating a deceptive pricing scheme. The plaintiffs, Townhouse Restaurant of Oviedo and Estero Bay Hotel Co., are small Florida businesses that operate a restaurant and a hotel, respectively. The plaintiffs purchased CO2 and leased or purchased related equipment within pre-printed contracts, according to the lawsuit.

The contract established fixed monthly prices that the customers would pay for products and equipment that is purchased or leased from NUCO2.

However, the plaintiffs accuse NUCO2 of violating its contractual agreements and entering into contracts knowing that it will increase the contracted prices without justification.

According to Townhouse Restaurant of Oviedo and Estero Bay Hotel Co., there are only two circumstances in which the company is eligible to increase prices: Annually, on the effective date of the contract based on a specific inflationary index, or up to 5 percent; or within 15 days of sending a price adjustment notification.

The plaintiffs initiated the class action lawsuit based on what they say are unfair Praxair prices. The automated price increase has been sent out without the required notice and not in conjunction with the effective date of the contract, according to the complaint.

The customers claim that the price increases are substantial, as much as 30 percent more per month than what the company originally represented.
