A Texas man recently filed a new hernia mesh surgery lawsuit against Davol Inc. and Bard, alleging he suffered from severe complications from a defective device.
The plaintiff, Shane W., says he was implanted with a hernia mesh device to repair an abdominal hernia on July 25, 2016. The specific hernia mesh used during this repair was manufactured by Bard.
Unfortunately, in the months following implantation with the mesh product, Shane alleges he began experiencing serious problems, including nausea, vomiting, and abdominal pain. He was admitted to the hospital on Dec. 6, 2016 because of these complications, eventually necessitating surgery to remove the mesh device.
According to the hernia mesh surgery lawsuit, Shane’s doctor found during the surgical procedure that the small bowel had become blocked where it had adhered to the mesh. The mesh removal surgery became more extensive than originally thought necessary in order to effectively remove the defective mesh.
According to the lawsuit, Shane was not adequately warned about the risks of the hernia mesh device. Shane filed his hernia mesh surgery lawsuit on April 10, 2018, in the U.S. District Court for the Southern District of Texas. The hernia mesh surgery lawsuit was filed on multiple counts, including manufacturing and design defect, failure to warn, and negligence, among others.
Shane is not the first patient to file a hernia mesh surgery lawsuit over these and other major complications, which can in some cases have long-lasting or permanent effects. If you or someone you love has suffered from side effects of a defective hernia mesh device, you may be able to file a hernia mesh surgery lawsuit.
Background of Hernia Mesh
Patients may be implanted with hernia mesh to reinforce a weak area or patch a hole caused by a hernia. Bard is just one of a number of manufacturers to make hernia mesh, along with Ethicon and others. Despite the popularity and widespread use of these devices, a growing number of patients implanted with hernia mesh are reporting serious hernia mesh side effects. In order to alleviate complications, many are forced to undergo hernia mesh removal.
A number of complications have been associated with hernia mesh, including:
- Chronic pain
- Hernia recurrence
- Rejection of the mesh
- Infection
- Device migration
- Scarring
- Inflammation
- Organ adhesion
- Erosion
- Tissue and nerve damage
- Death
Device migration can lead to more dangerous problems like infection, adhesion, and device failure. For some, symptoms may not appear up to several years after their hernia mesh was implanted. Serious complications can require patients to undergo revision surgery. Of course, any additional surgery can add further risk of infection and other complications, as well as additional medical expenses.
Filing a Hernia Mesh Surgery lawsuit
If you or someone you love has suffered from these or other side effects after undergoing hernia repair, even months or years after the fact, you may be able to file a hernia mesh surgery lawsuit. While filing a lawsuit cannot take away the pain and suffering caused by these side effects, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Hernia Mesh Surgery Lawsuit is Case No. 4:18-cv-01112, in the U.S. District Court for the Houston Division of the Southern District of Texas.
