Essure Side Effects LawsuitA Kentucky woman recently filed an Essure side effects lawsuit against Bayer Healthcare, alleging the device caused her serious injury.

The plaintiff, Rebecca E., was implanted with an Essure device after consulting with her doctor in the spring of 2015.

Her doctor provided her with an Essure brochure that allegedly stated the device involved a significantly shorter recovery period than tubal ligation.

The brochure also allegedly stated that the device was extremely effective at preventing pregnancy, and even had a lower risk of side effects than tubal ligation.

Rebecca E., at the encouragement of her doctor and assurances from the Essure brochure, underwent the Essure implantation procedure on April 16, 2015, the lawsuit states.

However, on July 21, 2016, Rebecca discovered that her left fallopian tube had not been occluded. The test that revealed this, known as an HSG test, also showed that the Essure device that should have been in her fallopian tube was actually in her uterus.

This Essure device migration posed a significant problem, so Rebecca required a hysterectomy in order to remove the Essure device from her uterus.

Because of the device’s migration and failure, Rebecca has suffered and even continues to suffer severe abdominal cramping, bleeding, and pain during intercourse.

The Essure side effects lawsuit was filed on multiple counts, including breach of express warranty, negligent misrepresentation, fraudulent concealment and misrepresentation, inadequate warnings, manufacturing defect, and violations of Kentucky’s consumer protection act, along with several others.

Essure Background

Essure birth control coils have become an increasingly popular method of permanent birth control. Essure was first released onto the market by Bayer Healthcare after the U.S. Food and Drug Administration approved it back in 1998.

The Essure device consists of two metal coils which are implanted into a woman’s fallopian tubes. After initial implantation, it takes several months for the coils to effectively prevent pregnancy.

During this time, the tissue around the coils grows, eventually blocking access to the fallopian tubes altogether and preventing pregnancy.

Essure Side Effects

Essure side effects lawsuits allege a number of serious Essure complications, including but not limited to the following:

  • device migration
  • hysterectomy
  • abdominal pain
  • pelvic pain
  • back pain
  • bloating
  • weight gain
  • heavy menstrual bleeding
  • irregular menstrual cycles
  • perforated organs
  • ectopic pregnancy

Filter migration and organ perforation are two of the most dangerous Essure procedure side effects. If the Essure device migrates from its placement, it can perforate nearby organs, leading to some very dangerous complications.

Filing an Essure Side Effects Lawsuit

These lawsuits allege that neither the public nor the medical community was adequately warned about the potentially severe Essure procedure side effects linked with the device.

Instead, Bayer Healthcare has continuously marketed Essure as a safer, simpler, and more effective method of permanent birth control than other options currently available to women, the lawsuit claims.

Thousands of women who have undergone the Essure birth control implantation procedure have later filed adverse event reports over a variety of serious side effects.

Plaintiffs involved in these lawsuits allege that, had they been adequately informed of these complications, they would never have been implanted with an Essure birth control device and avoided these risks altogether.
