A new pelvic mesh lawsuit was recently filed against C.R. Bard, Inc. (Bard). The lawsuit alleges that the plaintiff suffered pelvic mesh side effects caused by pelvic mesh complications.
Deanna D. and her husband Patrick D, residents of Missouri, allege that Deanna suffered from serious pelvic mesh complications as a result of being implanted with the pelvic mesh device.
According to the pelvic mesh lawsuit, Deanna was implanted with the Uretex TO2 Trans-obturator Urethral Support System. She was implanted with the pelvic mesh device back in April of 2007 at a hospital in Lebanon, Mo.
Claims against the pelvic mesh side effects lawsuit include negligence, breach of warranty, products liability and a loss of consortium claim.
The loss of consortium claim is brought by Deanna’s spouse Patrick. A loss of consortium claim alleges a loss of intimate and familial relationship with a person’s spouse.
Loss of consortium claims cannot be brought on their own – they must be joined to an original lawsuit.
Pelvic Mesh Side Effects
Thousands of women have had the vaginal mesh implant to help treat pelvic organ prolapse. Pelvic organ prolapse occurs when a woman’s bladder drops from its normal place and pushes against the walls of the vagina.
Medical professionals believe this can happen as a result of the muscles that hold the pelvic organ in place becoming stretched or weak from childbirth.
There are several serious side effects associated with having a vaginal mesh implant.
Some pelvic mesh complications include vaginal scarring, pain during sex, urinary problems, perforated bladder and bowels, mesh erosion into the vagina, and other organ injuries.
In some lawsuits the legal attorneys are claiming very little benefit is associated with using the pelvic mesh implant due to the significant complications and side effects that can occur when using the device.
Pelvic Mesh Lawsuit Information
Several pelvic mesh implant lawsuits have been filed against the medical device manufacturers.
Because a significant number of lawsuits have been filed, the cases have been consolidated into multidistrict litigation. Multidistrict litigation funnels all the lawsuits before a single judge for all pretrial motions and discovery proceedings.
In some situations, a few test trials will be performed so that other parties with similar lawsuits have a better idea what a fair settlement amount might be. The purpose of multidistrict litigation is to promote efficiency and consistency throughout the lawsuits.
Plaintiffs who suffered from pelvic mesh complications may be eligible to file a pelvic meshlawsuit against the medical device manufacturer. Plaintiffs who bring successful pelvic mesh lawsuits may be compensated for their pain and suffering and any medical bills they incur due to pelvic mesh implants.
Women who are interested in bringing a lawsuit and have had a pelvic mesh implant and suffered serious pelvic mesh side effects should speak to a legal professional about their potential claim.
The Pelvic Mesh Lawsuit is Case No. 2:16-cv-04533 in the U.S. District Court for the Southern District of West Virginia.
