Another Yaz/Yasmin lawsuit has been filed in the state of Georgia by plaintiff Lisa Wilkerson. The Yaz lawsuit includes allegations that Wilkerson suffered severe physical damage as a direct result of taking the oral contraceptive, Yaz.
Wilkerson is only one of hundreds of women that have allegedly suffered physical damage as a result of taking Yaz birth control. Injuries in past Yaz lawsuits and a Yaz class action lawsuit have included blood clots, heart attacks, pulmonary embolism, deep vein thrombosis, and even stroke. With such side effects becoming more and more prevalent among users, it is no surprise that birth control lawsuits have been piling up against the popular drug manufacturer, Bayer, for their oral contraceptive.
Background of Yaz/Yasmin
Yaz and Yasmin were initially approved by the Food and Drug Administration (FDA) in 2006 and 2001, respectively. Designed with the intention of helping to prevent pregnancy, the drug contains an estrogen component and a progestin component that work together to suppress ovulation, fertilization and implantation.
Progestin, a synthetic progestogen, is normal in birth control products. However, Yaz and Yasmin use a new progestin, drospirenone, considered a “fourth generation” progestin. Since this is a new progestin, there is little data available to actually support how safe and effective the oral contraceptive is.
In recent years, hundreds of Yaz lawsuits and Yaz class action lawsuits have been filed by women who allege the birth control pill and related drugs like Yasmin, Ocella, Gianvi, and Beyaz caused them to develop blood clots that led to complications like deep vein thrombosis, pulmonary embolism, stroke, heart attack, and even death.
Studies Released
In April 2002, the British Medical Journal reported from the Dutch College of General Practitioners a recommendation that older birth control pills be used instead of Yaz after discovering 40 cases of venous thrombosis among women taking Yasmin.
In February 2003, the British Medical Journal published a paper entitled Thromboembolism Associated with the New Contraceptive Yasmin that showed five additional reports of thromboembolism among women that took Yasmin, with two of those reports being deaths.
All reports include deaths associated with cardiac arrhythmia; some of the deaths had occurred in women as young as 17 years old.
Yaz Class Action Lawsuit vs. Yaz Lawsuit
Though Wilkerson filed an individual lawsuit, Yaz class action lawsuits are being filed by women that were adversely affected as a direct result of the oral contraceptive. A class action lawsuit is a type of group legal action that allows multiple people who suffered the same injury to band together to sue the same defendant. If a Yaz class action settlement is reached, all Class Members will share in the class action settlement award equally.
A person may always choose to file an individual Yaz lawsuit and pursue compensation based on their individual circumstances. Unlike a Yaz/Yasmin class action lawsuit settlement, which typically places a limit on the compensation awarded to Class Members, there is no cap on the amount of damages awarded in an individual lawsuit because each settlement is awarded based on the plaintiff’s individual circumstances and injuries.
