A woman and her husband filed a lawsuit against the makers of Taxotere and their related companies after the woman was treated with the breast cancer chemotherapy drug Taxotere and hair regrowth never resumed.

Plaintiff Linda R. and her husband Jerry R. filed their Taxotere hair loss lawsuit in the ongoing Taxotere multidistrict litigation underway in Louisiana federal court. Because there have been so many women alleging that they were treated with Taxotere and hair regrowth never happened, the Judicial Panel on Multidistrict Litigation consolidated the lawsuits under a single judge in a single court to begin addressing the claims.

In addition to using Taxotere, Linda also had other related products as part of her chemotherapy regimen including Docefrez, Docetaxel Injection, Docetaxel Injection Concentrate and other related drugs, her lawsuit states. Linda states that she began using the chemotherapy drugs in November 2007 and terminated their use in January 2008.

Linda alleges that she developed permanent hair loss as a result of using Taxotere. She has raised a number of allegations against the makers of the drugs including strict products liability for failure to warn and for misrepresentation, negligence, negligent misrepresentation, fraudulent misrepresentation, fraudulent concealment, fraud and deceit and breach of express warranty. She also alleges failure to conform to representations and warranties pursuant to Ohio law.

While Linda’s Taxotere and hair regrowth lawsuit does not specify the unique damages that and her husband she seek, the master form complaint for the Taxotere MDL alleges common requests for relief including damages related to medical expenses, physical injury and disability, physical pain and suffering, mental anguish and distress, loss of earnings, impairment earning capacity, loss of enjoyment of life. Her husband is likely alleging loss of consortium, or spousal companionship, as a result of the Taxotere injuries.

Taxotere and Hair Regrowth Failure

Linda’s Taxotere lawsuit, along with others in the multidistrict litigation, alleged that the makers of Taxotere engaged in a “cover up” of a causal relationship between Taxotere and permanent disfiguring hair loss. The lawsuit alleges that this was perpetuated by the defendants’ failure to inform the public, physicians and patients despite knowing for decades that permanent hair loss was a possibility.

“Although Defendants publish information in other countries to individual patients as well as regulatory agencies related to Taxotere and the risk of permanent alopecia, and despite numerous U.S. label changes in safety warnings issued by the Defendants since 1995, the words permanent alopecia or permanent hair loss did not appear in any information published by Defendants the United States until, at the earliest, December 2015,” the Taxotere and hair regrowth lawsuit states.

This neglect in warning patients caused thousands of women suffer from permanent alopecia and deprived them of the opportunity to make an informed decision as to whether the benefits of using Taxotere with its increased risk of hair loss was preferable over comparable products.

The Taxotere and Hair Regrowth Failure Lawsuit is Case No. 2:17-cv-07436-KDE-MBN and is part of the Taotere MDL In re: Taxotere (Docetaxel) Products Liability Litigation, MDL No. 2740, in the U.S. District Court for the Eastern District of Louisiana.
