Following approval by a federal judge, women are taking advantage of the opportunity for legal redress by submitting claims from the Suave Keratin Infusion class action settlement fund.
Suave Keratin maker, Unilever, agreed to pay $10 million to settle claims regarding the Suave Keratin hair smoothing kit, which was supposed to help rejuvenate the health of a person’s hair over the course of a 30-day treatment, according to advertisements for the treatment.
Instead, the Suave Keratin class action lawsuit alleged that the class members suffered from skin burns or worse as a result of the product, which were caused by the chemical formaldehyde.
It is the same ingredient that was the root of similar litigation regarding so-called “Brazilian Blowout” hair treatments. Formaldehyde is an extremely strong chemical that is used in industrial situations and as an embalming fluid. In the case of the Suave Keratin Infusion treatment and others, it can break down certain molecules which is supposed to result in less curly or frizzy hair.
Unfortunately for many women, according to the Suave Keratin Infusion class action lawsuit, in the wrong concentrations it can cause significant tissue damage. According to the National Library of Medicine, it’s a known carcinogen that can cause permanent eye damage. More significant for the women, ongoing “exposure to low levels of formaldehyde can irraitate and burn the eyes, nose throat and skin.”
While Unilever has not admitted wrongdoing by agreeing to the Suave Keratin Infusion class action settlement, women who submit a claim will be able to obtain a $10 cash reimbursement at a minimum, and a defrayal of the cost of any medical treatment necessary with certain documentation.
However, a separate investigation has begun and may result in additional or higher awards, even for those that did not suffer injuries as a result of the hair smoothing kit. It is based on the same side effects caused by the use of formaldehyde and whether or not Unilever adequately warned of the risks and made a safe product for consumer use.
