NuvaRing blood clot side effectsA NuvaRing lawsuit expected to join multidistrict litigation (MDL) in Missouri federal court includes allegations that a woman suffered from NuvaRing blood clot side effects as a result of using the birth control device.

Randee Perkins’ complaint is expected to be transferred into the NuvaRing MDL because there are common questions of fact regarding the vaginal contraceptive produced by Merck & Co. subsidiary Organon USA Inc., and the information provided to women about the potential risks for dangerous NuvaRing side effects.

The Utah woman’s specific injuries are not mentioned in the NuvaRing lawsuit, but she allegedly was unaware of the risks regarding the device because the pharmaceutical company “failed to properly disclose the known safety hazards associated with” NuvaRing. In fact, there were reportedly no studies to adequately assess the likelihood of NuvaRing blood clot reports because the drug maker relied on data regarding birth control pills that did not apply to the hormone used in the vaginal ring.

Women would not have had to deal with NuvaRing side effects like pulmonary embolism or deep vein thrombosis, according to the lawsuit, if the company did not engage in “utilizing dangerous levels of Progestin which was never before used as a starting agent in contraceptives and without first conducting adequate testing.”

As a result of this alleged lack of testing and in spite of an increasing rate of adverse event reports regarding the NuvaRing, many women were both unaware of the risks regarding the device and at risk for various clotting problems. Counts against Organon and Merck include defective manufacturing and design, failure to warn, breaches of express and implied warranties, negligence and fraud, among others. There are enough cases that many federal NuvaRing lawsuits have been centralized in MDL.

The NuvaRing side effects lawsuit is Randee Perkins v. Organon USA Inc., et al., Case No. 4:13-cv-1028, in the U.S. District Court for the Western District of Missouri.
