Union Bank (NASDAQ: UNB) has reached a $35 million class action lawsuit settlement over its overdraft fee policy, just months after a Miami federal judge ruled the bank would have to defend itself in the massive bank overdraft fee case: In Re Checking Account Overdraft Litigation.

Union Bank is one of more than 30 banks accused in the overdraft litigation of manipulating the order of debit card transactions so they can deplete customers’ checking accounts and trigger overdraft fees. Union Bank is also accused of “resequencing” checks so that checks for higher amounts were cleared first, causing checks for smaller amounts presented on the same day to bounce — again, triggering fees.

Bank of America recently reached a $410 million class action settlement to resolve its portion of the case, which was approved last week.

A written settlement agreement in the Union Bank overdraft fee class action lawsuit will be submitted to the court within 45 days, which will detail how consumers can receive their settlement benefits. The Union Bank overdraft fee settlement covers 350,000 non-commercial customers who were charged overdraft fees from January 2005 to August 2010 as a result of Union Bank’s “resequencing” of debits.

The case is In Re: Checking Account Overdraft Litigation, 09-cv-02036, U.S. District Court, Southern District of Florida, Miami.

    I’am set up for overdraft alerts but union bank only alert you after the NSF fees are applied. I will be close The account!!!!

    Union Bank is still doing it. Just happened to me again and there is nothing you can do. They don’t care if you leave the bank. Their motto is, “next sucker up. I made purchases with money in the account. Those got held and cleared after I made a night purchase that put me over. They over drafted me on the 4 purchases made way prior to the night purchase. In fact the night time purchase is still pending but they over drafted me on the other purchases anyways. On top of all that my check went in that same night. Doesn’t seem right. One last in fact, my account never truly reached zero. Unbelievable what can I do? Thanks

    my mother banked with union bank since 1994. january2014 was told it was to late to file a claim. july 2014 found it was not true. she has since passed…my father still is with us and union bank needs to pay my father what rightly belonged to my mother……plus some… THIS LAWSUIT DIDNT HELP ANYONE BUT THE ATTORNEYS!!! THEY MADE SURE THEY GOT THIER SHARE….

    Good Evening. I received a check in the mail on Wed May 21, 2014 in the amount of $210.02 dated 01/24/2014 issued by Union Bank Checking Account Overdraft Administrator. Check states it is void after 03/25/2014. I received in mail five months after issue date, two months after void date. There is a number to call 1-866-403-0685. A recorded message advising if you are calling for a check re-use you are past the date and no new checks will be issued. Shame on Union Bank for overcharging us customers to began with… even worst sitting on checks for this settlement and then mailing out stale dated checks. Spread the word about these poor business practices. Take your business elsewhere.

    I also noticed when checking my acct online that recent purchases would remain “pending” for up to 3 or 4 days before actually “hitting the books” and being deducted from my account until I made a purchase that would cause a small overdraft. That purchase amt would “hit the books” immediately, causing an overdraft and incurring fees for that and all subsequent amts that would have normally remained “pending”. Pretty shady, UB.

      Have not get 35 Million dollars in yeti …Union Bank overdraft. posted offers lady chesh my check.but not truth.that would Union Bank overdraft would said.please worn my lawyer.thanks you. . .

    on 11th day 11th month of 2012 I discovered in my statement I had in charge of my default for the last 11 months which was hitting in and so the the results is that I have 5 overdrafts so far this year 3 dollars and 95 cents a month for the last 11 months and 5 overdrive what point of view is that this game or stand oh is still happening I know I have at least 30 overdraft I am on a fixed income SSI disability I need every dollar just to survive in this economy I don’t even want to think of how much money how do I have lost and over the years I was homeless for 25 years pulled myself out of the gutters and skid row all I’m looking for is the hand up not a hand out
