Toyota interiorA class action lawsuit alleges Toyota and Lexus manufacturers misled consumers with a warranty program promoted as a fix for millions of car owners with defective dashboards.

The complaint claims “[t]he warranty program made promises Defendants could not keep.”

The Toyota class action lawsuit states that the auto manufacturers released several models of vehicles that had a latent defect in the dashboard – that would “melt or degrade upon prolonged exposure to the sun.”

The complaint asserts that Toyota knew about this defect, but did not inform affected vehicle owners. Instead, Toyota would offer costly repairs, thereby obtaining “further profit from the Defect by shifting responsibility for repair costs and delaying reimbursement for any repair costs for years.”

Several previous class actions were filed against Toyota to rectify this defect, according to the complaint. In 2014, those class actions were dismissed, but only “on the basis that millions of owners of automobiles with defective dashboards would receive voluntary and comprehensive warranty coverage,” according to the complaint.

However, the class action lawsuit asserts that Toyota did not have enough parts in stock to make the necessary repairs for every consumer, and also required the repairs to be done only at certified Toyota dealerships. Because of these restrictions, this lawsuit contends that “most” consumers have not been able to get their warranty work done. More importantly, the warranty period will expire on May 31, 2017, without these consumer being able to complete their repairs.

“Toyota is now in breach of its Program by failing to timely implement the repair component of the Program, leaving millions of consumers with defective dashboards and without any remedy,” the class action alleges.

Plaintiffs Wanda Jeffers and Jill Gibson state that they are mother and daughter, and jointly own a 2009 Toyota Camry affected by the dashboard defect.  They received a notice of the defect and warranty from Toyota, and say they contacted their dealership in Florence, South Carolina. The plaintiffs claim that they made “repeated contacts” with their Toyota dealership but their vehicle has not been repaired.

The misleading dashboard warranty lawsuit requests certification of a Class of all persons in the U.S. who own a vehicle affected by the defect. Affected vehicles include: the “2003-2005 Toyota 4Runner, the 2005-2010 Toyota Avalon, the 2007-2011 Toyota Camry and Toyota Camry Hybrid, the 2004-2010 Toyota Sienna, the 2004-2008 Toyota Solara, the 2006-2008 Lexus ES 350, the 2003-2008 Lexus GX 470, the 2006-2008 Lexus IS 250/350, the 2007 Lexus LS 460, the 2004-2006 Lexus RX 330, the 2007- 2009 Lexus RX 350, and the 2005-2008 Lexus RX 400h.”

The class action seeks compensatory damages, including damages caused by the warranty delay.

    Please add me to your list. I have a 2007 RX 350 with a cracked and sticky dashboard. I did not receive a letter from Lexus about the replacement program. I was only made aware of the program after it expired. I called Lexus Corporate and they basically said tough luck.

      same with me. I have 2010 IS350C and have taken amazing care of it but come to find out all the complaints I made in past were not documented therefore it is too late. Upon calling corporate, I was told that they did not have my apartment #. Now all of the sudden they do. I never received letter and Lexus definitely didn’t stand up for their loyal customers. Very sad that this is a $6,000 repair

    Sign me up on to the class action. My Lexus 2007 RX350 dash is covered in cracks and one just ripped open so there’s a big hole there now bc of the heat humidity. I never received any notice of recall or replacement available until I started researching and saw the time has expired and they refuse to replace it. The dash has always been sticky and dirty looking even after cleaning and detailing. Per the notice from Lexus I should still qualify as I am second owner and it is under ten years since I first got and used the vehicle.

    I also have a 2009 Lexus 350. Less than 89,000 miles. I am the third owner. My dash only started cracking sometime in mid to late 2020. Otherwise, no problem, except it falls outside of the time limit for replacement. I didn’t even realize there was a problem & had gotten someone to repair (as a gift). Within weeks, more cracks appeared. That’s when I started investigating. Called Lexus waited for a callback, was told Lexus would not cover, the time period was extended to 2018 & now it was past that time. Called at least 2 more times, was told NO again. Wait, how could I have called OR why would I have called earlier while the so-called warranty was still going on when my vehicle hadn’t even started to crack? I love my Lexus, but shame on them. You should never expect to have this happen to a luxury car such as a Lexus. Please add me to your list. Please add my name to any future class action lawsuits. Thank you.

    Add me to the lawsuit! I have a 2008 RX350 that has a cracked and cracking dashboard. Love the car, but the ugly dashboard is unacceptable from Lexus. The extended warranty is a joke, most people did not even know about the recall. I have been told by Lexus that they will not replace my dash since it is beyond their set replacement date. My dashboard did not start to show cracks until after the expiration date of the recall. As I said, add me to the Class Action lawsuit!

    I have a 2007 Lexus RX350. Cracks started to appear about 18 months ago and are now from the drivers side all the way across the dash board bottom edge. My car has always lived in a garage so there has been limited exposure to heat or cold Now a chunk of the dashboard has fallen completely off. I have received a repair quote from the Richmond VA Lexus dealer in the amount of $1057 for a new dashboard plus $600 installation. The car is otherwise in great condition. I never received a recall notice as others have said and from what I have read the recall expired in 2017. If there is a new class action lawsuit, please add me to the action. Unfortunately I’m not very confident that Lexus will be held responsible but I can hope.

    My 2010 Toyota Avalon started to experience craking of the dashboard panel at 20,000 miles although always garaged. I tried several times to schedule replacement but was told by the dealership that replacement parts are not available. It seems thatToyota offered a repair warranty but delayed the availability of replacement parts for many years. I contacted Toyota engagement center on 2/3/22 to find a solution Case number 220202001586 but was told that the repair warranty has expired. Add my name to this or future action lawsuits.

    The dashboard and door panels on my 2007 Lexus 350E was black, but is now sticky and turning an ash gray. The car has always been garage kept both at home and work. I have never received notification from the dealership about this matter. However, I plan to take my car to the dealership this week. Based on comments that I have read, it appears that Lexus has failed to address this problem. Please add my name to any future class action suits.

      I would like my name added to any future lawsuits as well. I NEVER received notice(s). In fact, when I filed a claim w/Toyota-Lexus they did not have my apartment # hence the reason for not receiving notice. I have informed my service advisor who, now I’m finding out, are told not to document in file. I inquired many many times prior to 3/31/21 and on 8/1/21 after what seemed to be fume smells were overwhelming that I realized it is the dashboard actually MELTING and giving off fumes smells.
      Service advisors are told not to document, and to NOT advise customers at all about this situation. My dealership had my car under my husbands name and again no apartment # noted. Funny how now both the dealership and Toyota-Lexus now have my apartment # on their records.

    Our car has been having the meltdown since 2008. We have always keep it garaged. It started with the unlock trunk release button that got very sticky in warm temperatures. It is documented
    Then all panels and dash boards. The Lexus dealer has had me bring in my car for photos twice. They said they had ordered them 2019, 2020 and 2021 September when I contacted them, they informed again they have been orded and that because of covid-19 it will take a little longer. I asked them to keep me posted at least every three months. They are have not keep their word. My Lexus 460 2007 cost us too much money for a company like Lexus to not honor their warranty.

    Please add me and husband to any class action lawsuit that pertains to this matter.

    I have the same issue with my 2005 ES300 with my dashboard and was never notified by Lexus because I was not the original owner. This seems like this should be a safety issue. Is there any new information on how we can get Lexus to fix our cars?
