Toyota interiorA class action lawsuit alleges Toyota and Lexus manufacturers misled consumers with a warranty program promoted as a fix for millions of car owners with defective dashboards.

The complaint claims “[t]he warranty program made promises Defendants could not keep.”

The Toyota class action lawsuit states that the auto manufacturers released several models of vehicles that had a latent defect in the dashboard – that would “melt or degrade upon prolonged exposure to the sun.”

The complaint asserts that Toyota knew about this defect, but did not inform affected vehicle owners. Instead, Toyota would offer costly repairs, thereby obtaining “further profit from the Defect by shifting responsibility for repair costs and delaying reimbursement for any repair costs for years.”

Several previous class actions were filed against Toyota to rectify this defect, according to the complaint. In 2014, those class actions were dismissed, but only “on the basis that millions of owners of automobiles with defective dashboards would receive voluntary and comprehensive warranty coverage,” according to the complaint.

However, the class action lawsuit asserts that Toyota did not have enough parts in stock to make the necessary repairs for every consumer, and also required the repairs to be done only at certified Toyota dealerships. Because of these restrictions, this lawsuit contends that “most” consumers have not been able to get their warranty work done. More importantly, the warranty period will expire on May 31, 2017, without these consumer being able to complete their repairs.

“Toyota is now in breach of its Program by failing to timely implement the repair component of the Program, leaving millions of consumers with defective dashboards and without any remedy,” the class action alleges.

Plaintiffs Wanda Jeffers and Jill Gibson state that they are mother and daughter, and jointly own a 2009 Toyota Camry affected by the dashboard defect.  They received a notice of the defect and warranty from Toyota, and say they contacted their dealership in Florence, South Carolina. The plaintiffs claim that they made “repeated contacts” with their Toyota dealership but their vehicle has not been repaired.

The misleading dashboard warranty lawsuit requests certification of a Class of all persons in the U.S. who own a vehicle affected by the defect. Affected vehicles include: the “2003-2005 Toyota 4Runner, the 2005-2010 Toyota Avalon, the 2007-2011 Toyota Camry and Toyota Camry Hybrid, the 2004-2010 Toyota Sienna, the 2004-2008 Toyota Solara, the 2006-2008 Lexus ES 350, the 2003-2008 Lexus GX 470, the 2006-2008 Lexus IS 250/350, the 2007 Lexus LS 460, the 2004-2006 Lexus RX 330, the 2007- 2009 Lexus RX 350, and the 2005-2008 Lexus RX 400h.”

The class action seeks compensatory damages, including damages caused by the warranty delay.

    My father’s 2007 Camry also have the dashboard melting issue. He never got the notice to replace. Please add him to the list should another lawsuit be filed.

    I have 2007 RX350 and my dashboard has cracked and has become sticky. I did not have this problem till late 2020. Now I am seeing more cracks develop. I did not get any letter from Lexus notifying me about the dashboard problem and warranty enhancement program. Please add me to this class action lawsuit.

    I own a 2007 Lexus IS 250 and have melted dashboard and door panels on all doors. I thought the issue was due to age and didnt realize there was many complaints going on. I have never received the notice and therefore have missed the warranty deadline but I also didnt have the melted dashboard and door panels until 2020. The melted dash board would fog up the windshield, emit noxious chemical smell, reflection from melted dashboard blind driving visibility. Please add me to this class suit

    The dash on my Solara has melted, cracked all over, and appears it may even fall off? This has to be a safety issue. Was never notified of dash replacement, but they never missed offering me an extended warranty by phone. My Solara has been babied, has less than 70K miles and is a 2006. If not for the cracked melted dash, she would be near perfect. It really bothers me! When I went to the dealership, not only were they no help, they were rude. Had missed replacement by just a few weeks. Please add me to the class action!

    I have a 2007 Lexus LS460 with a sticky dash and door panels which didn’t start to show until early in 2020. Since then, I went to the dealership and called Lexus and they both told me that the warranty to replace these areas had expired back in 2017 and there was nothing they could do and I would have to pay out of my pocket to have them all replaced!! I never even received a notice of the recall!!
    They knew of this defect and won’t even stand behind their product or their long term customers!!
    This will be the last Lexus we will ever purchase. Please add me to this lawsuit.

    We qualified for the warranty, but contacted Lexus after the deadline only because no ever notified us. Lexus denied our qualified claim.
    It is obvious that the repair scope is too broad a financial burden. We intend to do business with someone else instead of Lexus for our next vehicle.

    I have a 2009 Camry with a sticky dashboard. I never received a notice of there being a known dashboards issue nor did the dealership (Rt 44 Toyota in Raynham MA) ever mention anything about there being an issue when I had any service done to my car. They usually are good at keeping me up to date with any recalls or notifications from Toyota. This is a safety issue because of the glear caused by the shiny sticky dashboard.
    Please add me to this class action suit.

      I have a 2009 Camry with a sticky dashboard. I never received a notice of there being a known dashboards issue nor did the dealership (Rt 44 Toyota in Raynham MA) ever mention anything about there being an issue when I had any service done to my car. They usually are good at keeping me up to date with any recalls or notifications from Toyota. This is a safety issue because of the glear caused by the shiny sticky dashboard.

    We purchased a preowned 2008 RX350 from a Lexus dealer. The dash began getting sticky in one area but has now begun to spread across the entire dash. I had no idea this was a Toyota/Lexus issue. I started researching to figure out how to clean in and remove the sticky and ran across the articles about it. Please add me to the class action suit.

    I have a 2010 Toyota Camry with a sticky melting dashboard and was NEVER notified. The glare bothers me at night so I can’t do any night time or very sunny driving without throwing a towel on my dashboard. Toyota needs to pay for this until they reach all of their customers with this defective dashboard that is a safety and health concern.

    I purchased a preowned one owner 2008 RX350 in Dec 2019 from a dealer. It had fine horizontal cracks in the dash at the time, but I assumed it was due to age or sun exposure. Now the dash is getting sticky and small pieces have started to fall off. I didnt realize this was a recall problem til now. Please add me to the class action suit.
