Many different women have contemplated or already filed an Essure birth control lawsuit due to complications and side effects they say they were never told about.
An Essure birth control lawsuit might be the only way for these individuals who have been hurt after receiving Essure, a permanent birth control device, to get compensation for their injuries.
Promoted as a safe form of birth control, women implanted with the device reported severe side effects. Some of those users say they would have never considered the device if they’d known about the possibility of critical dangers and argue the manufacturer should be held responsible.
Some of the most common injuries alleged in an Essure birth control lawsuit include pain, nickel sensitivity, weight gain, hysterectomy, bleeding, perforation, unwanted pregnancy and auto immune disorders.
Essure birth control lawsuits have been filed against the manufacturer, Bayer, due to complications. Bayer is accused of hiding the complications caused by the birth control device. The total number of Essure birth control lawsuits filed in the United States as of April 2018 was nearly 17,000.
Those women who have opted to file an Essure birth control lawsuit say that these auto immune problems, organ perforation issues and other side effects were never explained to them when they received the device. Women in some of these lawsuits say that pieces of Essure break away from the Fallopian tubes, perforate organs and corrode; causing havoc on the patient’s body.
More than 26,000 adverse event reports were filed by patients who received Essure birth control as of January 2015 with the FDA. The reported side effects may be severe and cause a woman to miss time at work and to significantly adjust her day to day activities.
Filing an Essure Birth Control Lawsuit
Many of the women who filed an Essure birth control lawsuit say that they had to do so because of the failure to warn about side effects.
These Essure lawsuits allege that the makers of the device failed to provide sufficient information about the risks of the birth control device to the FDA in order to receive approval. The lawsuits also allege that Bayer never went through with the appropriate steps to train physicians about how to use Essure.
Some of the most common allegations in the Essure birth control lawsuits include, failing to track complications, failing to report or even actively concealing adverse events linked to Essure, failing to have a complete risk analysis for the device, handing out equipment to physicians without appropriate training, encouraging doctors to sell Essure to patients, failing to train doctors on how to use Essure and failing to disclose the more than 16,000 medical device complaints about suspected malfunction to the FDA.
Anyone who has already been hurt by the Essure birth control device might need to consult with an attorney about their rights to file a lawsuit. If you know someone who has already been harmed by the Essure birth control device, time is of the essence to gather evidence and lodge a legal claim.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
