An Illinois man unhappy about receiving unwanted text messages from Donald Trump’s campaign committee has filed a text message spam class action lawsuit.
The text message spam class action lawsuit alleges the Donald J. Trump for President group sent text messages that violated the Telephone Consumer Protection Act (TCPA). The Trump Committee is the main campaign committee for Donald Trump’s presidential campaign.
Plaintiff David Roberts alleges that the Trump Committee sent unwanted text message spam to voters who had not given prior express consent to receive such messages.
Text Message Spam Class Action Lawsuit
According to text spam class action lawsuit, text message spam from the Trump for President committee included text messages such as:
“Reply YES to subscribe to Donald J. Trump for President. Your subscription will help Make America Great Again! Msg&data rates may apply.”
The text message class action lawsuit alleges that the Trump Committee either sent text message spam personally or had another party send it on the committee’s behalf to voters who had not given consent to receive these messages, violating the TCPA.
The text message spam from the Trump Committee caused consumers real harm, the lawsuit further claims, given that these kinds of messages may be emotionally aggravating, and also because some consumers have to pay to receive these texts despite not wanting to receive them in the first place.
The text spam class action lawsuit also notes that text message spam contributes to diminished battery life and wasted data storage, as well as constituting an intrusion of privacy.
Roberts filed the text message spam class action lawsuit on behalf of himself and all others in a similar situation who have received text message spam from the Trump for President campaign committee.
If certified, class members will include those who received an unwanted text message from the Trump Committee between June 2015 and the lawsuit’s filing.
The unwanted text message spam class action lawsuit seeks to stop the campaign from sending further text message spam, as well as to recover damages of $500 apiece for each violation of the TCPA.
Unwanted Text Messages
According to the Federal Communications Commission, or FCC, intrusive unwanted messages, through robocalls and texts, make up their top consumer complaints.
The FCC even warned specifically about political robocalling and text message spam, issuing an advisory on October 21, 2014 “Warning Political Campaigns and Promoters Against Robocall Abuse.”
Despite the illegality of these violations, many campaigners continue to send text message spam every year.
David’s proposed class action lawsuit notes that 69 percent of cell phone users who use text messaging receive text message spam. Though for many of these people spam is more rare, 25 percent deal with regular text message spam, receiving these kinds of messages at least once weekly, according to the Pew Research Center in a 2012 study.
If you have received text message spam or robocalls from a company or group such as the Trump for President campaign, you may be able to report violations and receive compensation. Keeping messages and phone records will help you provide proof of these violations.
The Trump for President Text Message Spam Class Action Lawsuit is David Roberts v. Donald Trump for President Inc., Case No. 16-cv-4676 in the U.S. District Court for the Northern District of Illinois.
