Slip and Fall Injury Leads to Claim Against The Cheesecake FactoryA New York man recently filed a new lawsuit against The Cheesecake Factory over a slip and fall injury, alleging the restaurant chain’s negligence caused this injury.

The plaintiff, Nicolas H., says he was at a Cheesecake Factory location in New York on July 29, 2017 when he slipped and fell on the premises, leading to serious injuries. According to his lawsuit, Nicolas’s slip and fall injury was caused by “negligence, recklessness, and carelessness” by the company. The lawsuit alleges that the Cheesecake Factory’s floor was wet and slippery, but employees failed to warn about the risk of these areas, causing Nicolas’s slip and fall injury.

According to the lawsuit, Nicolas’s slip and fall injury is serious and permanent, leading to pain and suffering as well as medical expense, and affecting his ability to go about his normal daily activities and duties.

The slip and fall injury lawsuit was filed on May 31, 2018, in the New York Supreme Court.

Filing a Personal Injury Lawsuit

A slip and fall injury like Nicolas’s can be devastating, but those who have suffered from injuries like this may find that filing a personal injury lawsuit can help them with compensation. Personal injury claims, like this slip and fall injury lawsuit, frequently rest on the concept of negligence—that is, the idea that another party’s negligence or carelessness led directly to your injuries.

Negligence is legally defined as “the failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect oneself or others from bodily injury, death, property damage.”

Filing a Slip and Fall Injury Lawsuit

A slip and fall injury lawsuit like Nicolas’s is a common form of personal injury litigation. Other personal injury lawsuits include birth injuries, work injuries, dog bites, medical malpractice, and car accidents, among many others.

If you have a personal injury claim and want to seek compensation, you may be able to file a lawsuit. A personal injury lawsuit can help compensate for medical bills, lost income, physical pain and suffering, loss of enjoyment of life, disability or disfigurement, property damage, emotional distress, and/or wrongful death. Filing a personal injury lawsuit cannot take away the pain and suffering caused by injuries, but it can help to alleviate the financial burden caused by medical expenses and lost wages.

The Slip and Fall Injury Lawsuit is Case No. 1:18-cv-03193, in the Supreme Court of the State of New York, County of Queens.
