On June 30, a California federal judge gave preliminary approval and class certification for a proposed $11.7 million recorded call class action settlement, which would resolve claims that Six Continents Hotels Inc. recorded consumers’ service phone calls without their express consent.
Per the terms of the recorded call class action settlement, Six Continents has agreed to not oppose the plaintiffs’ motion for class certification. Magistrate Judge Nathanael M. Cousins granted Class certification, as well as preliminary approval of the Six Continents class action settlement and a motion to amend the original plaintiffs’ class action lawsuit.
Back in September 2012, Plaintiffs Laura McCabe and Latroya Simpson filed this recorded calls class action lawsuit against Six Continents and named two additional InterContinental Hotels Group PLC company units as defendants. In filing this Six Continents class action lawsuit, McCabe and Simpson seek to represent a Class consisting of 7,000 California residents whose phone calls to the hotel company’s customer service number were allegedly recorded without their permission.
According to the recorded calls class action lawsuit, the named plaintiffs and Class Members placed cell phone calls to Six Continents’ toll-free numbers to inquire about the hotels’ rates and reservations. McCabe and Simpson allege that during these phone calls, they and other consumers gave sensitive personal information (such as credit card information) to Six Continents, and were never informed during the call that conversation was being recorded.
Despite motions of summary judgment against the plaintiffs and the Class by the defendants, the Six Continents recorded calls class action lawsuit survived, and both parties entered into mediation talks in January of this year, leading to the current class action settlement agreement.
The Six Continents class action settlement states that the hotel company will pay $11.7 million, which includes payment of attorneys’ fees and Class costs. Six Continents has further agreed to inform those associated with the telephone numbers that were routed to the company’s call centers, of the opportunity to join the recorded calls Class.
Eligible Class Members will have until Dec. 13, 2015 to submit their claims or file objections to the Six Continents class action settlement. Judge Cousins states that if all potential Class Members submit claims and proposed settlement award is given final approval, then it is likely that each Class Member will receive about $10.82.

it seems like they approved every claim form that was submitted. this is based on how many claim forms they claims administrator says were submitted at the final order date and the total payout amount. this is very frustrating for someone like myself who did receive a claim form. I am a california resident and have been a part of california only class actions where the claims administrator actually verified every claim submtited. I received over $500 from those lawsuits. I will be objecting lawsuits where I receive claim forms going forward so that the court can confirm that the claims administrator will be verifying each claim form.
stop being an idiot, you are just greedy and once you object over 3 claims you are going to be made to start paying for your own attorney to object….I bet you will stop objecting then.

I just read the court docs, and 36,240 timely claims 649 of those where paper claims and additional 480 untimely claims , those were included at the final approval, so 35,591 timely online claims , all were approved $cash payout $208.01 ,
my bad , its $205.29 it would have been $208.01 if they did not include the 480 claims
It could be more than that. Timely claims doesnt necessarily mean approved claims. Those are just claims that were submitted on time. There was another California only lawsuit where more than half of the submitted claim forms were not approved because the company didnt have any records of ever recording their calls
I have pacer and that’s what the final hearing stated all claims to be included including late claims and that was on 2/8/2016, but we will see as I know some of the administrators don’t like sending some people checks. I am thinking they slip it in their pockets

Just received an email form the administrator stating my claim was approved and that checks will be mailed out on the 22nd of April. Definitely good news. He mention the amount.

either the lead plaintiff or the judge are way off on their calculations…plaintiff expects class of 7000 into maybe a net fund of 7 mil-that’s a grand each in cash relief. the judge estimates only $10.82 per claim—–big discrepancy.
