Sea WorldSeaWorld in San Diego has been hit with a proposed class action lawsuit accusing the marine animal park of illegally collecting visitors’ ZIP codes during credit card transactions.

Plaintiff Andrew Dremark alleges in the class action lawsuit that he was asked by a SeaWorld cashier in June to provide his ZIP code while paying his parking lot fee. Dremark says he complied because he believed he had to provide his ZIP code in order to pay.

Dremark later learned that the cashier’s request violated California’s Song-Beverly Credit Card Act, which prohibits companies from collecting personally identifying information such as ZIP codes, addresses and phone numbers during credit card transactions.

“There is no legitimate need for SeaWorld to collect a credit card customer’s personal identification information in order to complete the credit card transaction,” the SeaWorld class action lawsuit states.

The company allegedly collects the ZIP codes and other customer information like phone numbers, email addresses and purchase histories in order to create targeted marketing campaigns, according to the class action lawsuit. SeaWorld might also “sell, rent, trade or otherwise disclose” the personal information to other businesses, the class action lawsuit says.

Dremark is seeking to represent a statewide class of consumers who allegedly had their privacy compromised by providing their ZIP codes during credit card transactions at SeaWorld.

The SeaWorld ZIP Code Class Action Lawsuit case is Dremark v. SeaWorld Parks & Entertainment Inc., Case No. 3:13-cv-00313, U.S. District Court for the Southern District of California.

The plaintiff is represented by Timothy G. Blood, Thomas J. O’Reardon and Paula M. Roach of Blood Hurst & O’Reardon LLP.

    yep, when we lived in San Diego we would take family to sea world they asked all the time!!

    Yes, I remember getting asked by Sea World cashiers what my zip code was while visiting the park. How do I go about becoming involved in this lawsuit settlement?
