Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    have had my machine less than a year ago last black friday and have had 2 episodes of lung (both fungus in lungs and treated for 6 weeks with antifungal medicine and now currently have yeast infection in lungs. ) Never had lung ailments in past and other members of family have chronic cough as well. Clothes always smell musty, mildew even though I have maintained the machine as instructed to do. Whole family has had a list of odd ailments since this machine has been brought into our home. Wondering if anyone else is having respiratory sx related to fungal infections?

    My Samsung washer broke after a few months and caused thousands of dollars of damage only to brake again a few months later. Samsung has refused to repair/refund me. How do I join the law suit?

    We also have this problem. There is a video on utube about it also. How can I get in on this lawsuit? We purchased the WF419 and are haveing the same issues, but ours has a major defective part that render the washer useless and would cost more to fix than we paid for it new. Basicly ignored by samsung and told that it is out of warrenty.

    I too have problems with my Samsung SM HE FL WASHER WF210ANW..I purchased it in April of 2012….it leaves the towels smelling like dirty dishrag, the interior of the unit also has a fowl order (I now run one cycle with just water and bleach to remove the smell and leave the door open after every wash), it cannot accurately was “heavy loads” as touted in their ads… I washed a king size comforter it came out sopping wet, it didn’t spin properly and the machine made a horrendous noise. I too had error codes, I called Samsung and left numerous messages…I am now out of warranty and still have these issues. How do I join the class action?????

    I too have one of the above mentioned model numbers and mine smells HORRIBLE!! Ive tried everything and nothing has worked. Ive spent hunderds of dollars on all kinds of products to remove, mask, and clean the washer and nothing has worked.

    Yesterday our Samsung front loader washer made a loud noise…like someone started a Harley in my laundry room. We stopped the washer which was in the spin cycle and smoke came out. Model # WF210ANWXAA It is 3yrs old and just out of warranty. It also leaves the towels smelly and hard and scratchy it does not clean the clothes well. We wanted to replace it but just couldn’t afford to especially after spending so much on this unit in the first place. Very disappointed!

    My washer let out a bunch of black smoke and my clothes very smoky and smelly. Unfortunately it was all the nice dress work shirts that I own. Very upsetting.

    WOW! I am suffering from a large loss due to my top load Samsung machine. Pump fell off the bottom and flooded my daughters room hall and TV room. 10K + in damages so far. I have the extd. Warrenty and still have had no help from Samsung to resovle this matter.
    Had to let it up to the ins co.
    How do I join the class action suit?

      Jody, this just happened to me. The Samsung machine flooded by top floor and the water leaked to my second floor causing major damage.

    I bought one of these washers and have the same problem with Towels and other laundry that smell even though they were just washed. We have contacted Samsung before about the smell and they just told us to run the sanitized cycle but this did not help. How can we be part of this class actin lawsuit? Tried of towels smelling dirty as soon as they come out of the washer.
