Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    Just had a catastrophic failure of my drain pump, and it flooded a large portion of the downstairs. I had the pump replaced yesterday, and now I’m told that the main board and wiring harness need replacing! After reading negative comments of a similar nature about this model on the Lowe’s website, I don’t think I want it repaired. My model is WA456DRHDWR/AA. What do I do to be a part of this lawsuit?

    I have all of the same complaints. I never knew about this law suit until the news aired yesterday on it. My clothes, especially towels, smell horrible after they are washed. There is mold and mildew down in the rubber part of door. It also puts holes in any cotton shirt I own. I would love a new machine. I bought the Samsung front loader washer & dryer and paid over 2400.00 to Lowes. Any info would be greatly appreciated.

    I have the same problems with mildew smell and have been battling this machine for years to correct the problem. I’ve also replaced the drain pump three times in two years. I would like to be part of this class action lawsuit. I leave the door open, drain the water from the hose on front bottom left, use Clorox on about everything just to stop the smell, spent money on the drum washing tablets and run the pure cycle once a week, and nothing helps. My only solution is to get rid of this 3 yr old front loader samsung garbage….. I never had these issues with my old 3 cycle top loader!

    My spider arms in the back of the drum corroded, broke and damaged the drum, door seal and bearing. I called for service before the 3 year warranty but could not get an appoint for a week. Just after the 3 years. When the ‘tech’ arrived, he ran the machine on the spin cycle for 15-20 seconds and told me “your bearing is shot, that will be $87 dollars and I’ll call you with an itemized repair estimate.” A week later he called stating it would cost $775. He told me to call Samsung back and they would authorize covering all or part of the repair. I called and talked with numerous reps all of whom refused to authorize anything. I will never buy any samsung product as they will not stand by the warranty.

      Agree, Samsung tech support and customer service is very poor….they are not worth the lowest grade. I bought a WF56H9100AG the largest front load washer dryer set Nov 2014. The day I took delivery of it after delivery left it started having problems. From day one I have called Samsung every month on part repairs from door latch and latest is replacing the washer drum housing, drum, spider gear, seals at cost over $675. The first drums came in bent gear shaft and would not work. Week later we have another drum delivered that shipping carting looks worse than first one. Techs suppose to be here tomorrow and will see if can be used for repair after waiting month. Samsung service tech supports and follow-up is the poorest I have seen of any service appliance–no help and does not want to take responsibility for repairs. My original year warentee does not run out until Nov and I have the extended warentee for another three years. After that Samsung will no longer ever be in my home.

    My washer has been leaking the whole time. It took a very long time to put 2 and 2 together and figure it out. It only leaks sometimes so we didn’t notice it. When it did leak, it would go into one of the drawers below, so we didn’t notice it because we barely used the drawers. When I did notice it, I thought it was coming from the door. Then when I would check the drawers for leaks, there would be no leaks for weeks. Then later down the line a few months, there would be water in the drawer. I assumed maybe someone was accidently opening the washer. I started getting really sick, then my whole family started getting sick. When we were very sick the washer started leaking big time. I was able to tell it was leaking when my closet started smelling like mold. But we couldn’t feel any water in the closet when we noticed the smell. I was not using that closet a lot, so I would have not known if the carpets were wet at one time. My doctor diagnosed me with fibromyalgia, because he could not figure out what was wrong with me. Then when my whole family got sick, we had to flee my house into a hotel room. We realized we had a mold problem. We have traced the source to the washer. The washer still will not leak all the time, so it has to be a defect in the machine. It has ruined my health and my life and I do not ever think I will ever be the same. It is really messed up that if the machine does leak, if you have drawers to catch the water you will not notice you have a leaking problem, unless you use the drawers every time you do a wash. It can take your life. Who would of ever thought. Not me.

    I bought this washer several years ago and I have the same problem , my clothes smell like a dirty old sock . It’s nasty ! I have thrown lots of clothes away because I can’t get the smell out . What do I need to do to be a part of this lawsuit ?

    I have a major mildew problem and have spent hundreds of dollars in Affresh tabs, Tide machine washing cleaner, and home detergents to stop the spread of this mildew. I have kept it from getting worse as I spend a lot of time washing this dumb machine. Should have stayed with Samsung. What do I need to do to be a part of this lawsuit. I am outraged with Samsung customer experience and service.

    My washer leaks and smells horrible…my clothes never seem clean
    My whites are not white
    Been serviced twice now out of warranty
    What a waste of money
