samsung-logoA class action alleges that a supposed recall of Samsung washing machines at risk of exploding is a ploy by the company to make even more money selling new washing machines.

On Nov. 4, 2016, Samsung issued a voluntary recall of its top-loading washing machines manufactured between March 2011 and November 2016, after hundreds of complaints and several reports of property damage and personal injury from the exploding machinery.

For the recall, Samsung offered its customers three options. First, the customer could schedule a repair of the washer, where a technician visits the home to reinforce the washer at no cost.

Second, the customer could get a rebate towards the purchase of a new washing machine. And third, Samsung offered a full refund, but only for customers who had their washer for less than 30-days.

Plaintiff Malori Soria states that she purchased a Samsung washing machine in October of 2015, and learned in 2016 that her model washing machine was subject to a recall by Samsung.

Soria says that options 2 and 3 of the recall did not work for her, since her washer was more than 30-days old and the potential rebate would cover only “a fraction” of the cost of a new washing machine. So Soria says she made 15 attempts to accept option 1 and schedule a repair of her machine, but to no avail.

According to the class action, Samsung is “intentionally withholding repair of Soria’s Samsung washing machine so that she would be forced to use the rebate or to purchase another Samsung washing machine, thereby creating business for Samsung and saving Samsung the costs of the reinforcement measures.”

This is not the only lawsuit Samsung is facing over its washing machine recall. Earlier this month, a class action was filed by plaintiff Jerry Wells of Oklahoma alleging similar experiences as Soria.

In his complaint, Wells claims that he also tried to schedule a repair of his top-loading Samsung washer, but without success. In addition, Wells notes that previously on two separate occasions a Samsung technician had no problem scheduling a visit to repair his washer, but the repair for this specific recall has not been completed.

Here, Soria seeks to represent a Class of all persons in the U.S. “who purchased a new Recalled Washing Machine or otherwise acquired a Recalled Washing Machine from March 2011 to November 2016, primarily for household use and not for resale.”

The class action requests two forms of relief from the court: “(i) an injunction enjoining Samsung from any further sales of the Recalled Washing Machines, and to take such other remedial action as may be otherwise requested herein; and (ii) money damages to adequately and reasonably compensate owners of the Recalled Washing Machines who have through no fault of their own purchased defective and dangerous Samsung washing machines.”

Soria is represented by Stephen H. Kupperman of Barrasso Usdin Kupperman Freeman & Sarver LLC and William B. Federman of Federman & Sherwood.

    We purchased this washer from Sears. We ended up having to buy a new washer which, in the long run, even with Samsung’s credit, cost us more money. Please add me to this list!

    Our brand new washing machine was one of the recalled machines. I called Samsung and requested a replacement. They REFUSED to give me that option. Along with the washer and dryer set, we had purchased an extended warranty.
    Our washing machine WAS repaired, after many attempts by Samsung to slow the process. However, we are experiencing new problems with the defective washer. Samsung is now saying that the warranty we PURCHASED is not applicable because the machine is ‘defective.’ The defect warranty expires in March, so we are stuck with a defective NEW washer, with no warranty, which we payed thousands for the washer/dryer set!! Currently, I’m having to wash my work uniforms in the bathtub at night after work because I have to be at work at 7am! I don’t even know what I’ll do about the kids’ school uniforms this weekend because I have to work!!!

    I purchased this top loading washer 2 1/2 years ago. It blew and spewed water and flooded my laundry room and bathroom. I slipped and injured myself. I am a 70 yr old woman with hardware in my back. I had to buy a new washer and still waiting for my rebate which is 1/3 of what I paid for it. Samsung should be shut down.

    We were able to get a repairman out to install the “fix” on our Samsung washer. I was told by the repair company to refrain from using anything other than the low spin cycle. The washer doesn’t clean the clothing/bedding/towels properly. We have recently had to use a laundromat while waiting for yet another repair, and our clothes actually came out clean. Imagine that! I verified with the repairman that I need to avoid using the high and medium spin cycles. He said correct. The “fix” Samsung came up with is nothing but a band-aid. It irks me to no end that I cannot use the washing machine for its intended purpose and it doesn’t do what it is supposed to do….clean the laundry.

    We also got suckered inot the rebate so called check it wasent even the amount it was suppose to be now I have the newer version as they call it.it makes a load noise I call them and they tell me we don’t have the hose pushed in far enough in the wall…well there people installed it..we tryed pushing it in still the same it’s just junk does no good to call them all they do is argue when you ask for a superviser there no ware to be found.there just crooks in my opinion stole our money on first bad purchase then did it again on the rebate check so we’re still out hundreds of dollars.

    LG got away with the same crap and Samsung more than likely will to. Our government takes a back seat to this and all the other things that ruin our economy. Nissan and all the other big companies just keep dumping junk in this country while our law makers just sit back and collect pay checks.

    Mine has been repaired, but it is very loud when it spins and vibrates a lot.I find myself putting it on the low spin cycle all the time. Makes me nervous!!

    Samsung reps have visited my home several times to make repairs to my top loaders washer and I am still expercing problems with extreme shaking and loud rocking during the spin cycle. I try to stay away from the washer when it is spinning for fear it will explode. I called Samsung again on Feb 3 to report this issue, and of course – I will have to wait two days to receive a call from a tech and another day or so for a rep to come out.

      I’ve had the same trouble. I got on the repair list and I’ve been passed around from repair company to repair company stating that someone would come but then no ever does. I’ve been waiting for my Samsung washer repair since at least November 2016 and it is now February 2017. Keep me posted on to how I can get involved. I still have the emails form these repair companies. I also have paper work and stickers from Samsung themselves about how to fix it.
