samsung-logoA class action alleges that a supposed recall of Samsung washing machines at risk of exploding is a ploy by the company to make even more money selling new washing machines.

On Nov. 4, 2016, Samsung issued a voluntary recall of its top-loading washing machines manufactured between March 2011 and November 2016, after hundreds of complaints and several reports of property damage and personal injury from the exploding machinery.

For the recall, Samsung offered its customers three options. First, the customer could schedule a repair of the washer, where a technician visits the home to reinforce the washer at no cost.

Second, the customer could get a rebate towards the purchase of a new washing machine. And third, Samsung offered a full refund, but only for customers who had their washer for less than 30-days.

Plaintiff Malori Soria states that she purchased a Samsung washing machine in October of 2015, and learned in 2016 that her model washing machine was subject to a recall by Samsung.

Soria says that options 2 and 3 of the recall did not work for her, since her washer was more than 30-days old and the potential rebate would cover only “a fraction” of the cost of a new washing machine. So Soria says she made 15 attempts to accept option 1 and schedule a repair of her machine, but to no avail.

According to the class action, Samsung is “intentionally withholding repair of Soria’s Samsung washing machine so that she would be forced to use the rebate or to purchase another Samsung washing machine, thereby creating business for Samsung and saving Samsung the costs of the reinforcement measures.”

This is not the only lawsuit Samsung is facing over its washing machine recall. Earlier this month, a class action was filed by plaintiff Jerry Wells of Oklahoma alleging similar experiences as Soria.

In his complaint, Wells claims that he also tried to schedule a repair of his top-loading Samsung washer, but without success. In addition, Wells notes that previously on two separate occasions a Samsung technician had no problem scheduling a visit to repair his washer, but the repair for this specific recall has not been completed.

Here, Soria seeks to represent a Class of all persons in the U.S. “who purchased a new Recalled Washing Machine or otherwise acquired a Recalled Washing Machine from March 2011 to November 2016, primarily for household use and not for resale.”

The class action requests two forms of relief from the court: “(i) an injunction enjoining Samsung from any further sales of the Recalled Washing Machines, and to take such other remedial action as may be otherwise requested herein; and (ii) money damages to adequately and reasonably compensate owners of the Recalled Washing Machines who have through no fault of their own purchased defective and dangerous Samsung washing machines.”

Soria is represented by Stephen H. Kupperman of Barrasso Usdin Kupperman Freeman & Sarver LLC and William B. Federman of Federman & Sherwood.

    I am part of the recall too… total disapointment as our washer is only 3 years old and paid over 600.00 on sale to get it, and could not afford to take the 150.00 offering rebate due to being on SSA and senior can not afford to replace this defective washer. On top of it all, has been 3 months + of arguments, multiple phone calls to both the local repair service company and samsung direct to get a repair man to complete the job…finally yesterday he came, supposedly a simple fix of attachment brace to the machine, I don’t buy it, but time will tell, then you have to use different settings with a new label supplied changing the settings from it’s original manufactured settings to use the machine for heavier use such as bedding etc. So This is just a very bad business – also stated on phone an extended warranty on the machine for one year, NOT seen any such paperwork on this either. So does this mean the 10 year warranty through samsung is defunked too? Have no clue. EVERYONE should have been offered a new machine for free, this is not our fault but the manufacturing company — now for those who can not afford a new machine, are stuck not knowing if theirs will be the next one to expload and cause damages to home and self. I am still very worried about this situation but have no choice but to wait till it does happen even with the ” brace” which I doubt will last long to begin with! Shameful business transaction on Samsung.

      i had the washing machine for only 6 months and i was not going to get much for it but they did come to my house and all they did was put new bolts for the lid to not to pop up

    We went through this too. Our Samsung washer was only a few years old, cost over $600 and only got $136 towards a new one! Absolutely ridiculous and totally screwed out of hundreds of dollars!! A washing machine that expensive should have many many more years than 3 to its life …. And Samsung should compensate all of us for that!!

    I too have experienced the same scenario as Soria. I have been given a rebate offer but am unable to find a replacement washer the same cost as the rebate amount. I cannot afford to pay more for a new washer, not should I have to considering the issue is related to a manufacturing defect.

    me to it is a finish crashing company for sometime now that the old man die! The kids (Samsung) don’t care lost there way to making the customer the best, not to be writing like this!.

    How could the fix have been tested in long term R&D testing, when Samsung came up with the fix in less than 3 months…long term testing could have not been sufficiently taken place!

    I’ve received my letter for the RECALL/ REFUND for my Samsung. I dont care for any of the options.
    I’m not sure how “repaired” the repair is.
    At my age, I figured this would be my last washing machine and I forked out the money for the 5 yr. warranty. Very disappointed with the machine BEFORE the recall. It doesnt seem to wash the clothes all that well. If I ever get another washer, it wont be a Samsung.

    I purchased Top loader washer Feb.2014, last year..October 2016 machine quit working right. No spin and water filling up to top when I had only spin on.
    I took a 5 year warranty on my machine. At first my machine came under warranty..needed a whole new mother board…which was installed in November..2016′ but needed another part or parts. In meantime my machine was on recall list. A guy came to fix that problem..which put my machine back on Samsung warranty for another year. Hopefully my extra..warranty I purchased will still be in effect. Finally since October 2016 ..I finally had Samsung come again and repair today. Jan 31,2017! Major problems. I paid almost $600 which was on sale. I pray to God..I will have a functioning machine! Won’t know until I wash some loads. First time repaired under ex warranty I purchased and 2 X Samsung repairs. Regrets to say the least!!!!

    I finally got a “repair” on my third attempt. No show on first two. So he attatched a bracket and pins and told me I could no longer use my machine to wash bedding on the heavy duty cycle with hot water. Have to wash on delicates. The fix is not a repair that allows you to use the machine for the use it was intended for. Offered me $150. For a 3 year old $900. washer. Huge scam!
