Samsung laptop class action lawsuit overview:

  • Who: Haley Williams filed a class action lawsuit against Samsung Electronics America Inc.
  • Why: Williams claims Samsung knowingly sold laptops containing an defect that causes them to overheat when performing even basic functions.
  • Where: The class action lawsuit was filed in New Jersey federal court.

Samsung laptops marketed by the company as having “superior computing power and speed” have a defect that causes them to “excessively overheat when performing basic laptop functions,” a new class action lawsuit alleges.

Plaintiff Haley Williams claims Samsung is aware about the alleged overheating defect that she argues affects its Samsung Galaxy Book, Samsung Galaxy Book Pro and Samsung Galaxy Book Pro 360 laptops.

Williams argues Samsung, however, fails to disclose its knowledge of the defect or try to do anything to remedy it, leaving consumers “exposed to danger” and deprived of being able to use the devices.

“Samsung has known of the danger posed by the Class Laptops for years. However, Samsung has failed to disclose its knowledge of the Overheating Defect or take any other action to rectify the issue,” the Samsung class action states.

Williams wants to represent a nationwide class of consumers who purchased a Samsung Galaxy Book, Samsung Galaxy Book Pro or Samsung Galaxy Book Pro 360 laptop from Samsung’s website.

Samsung deliberately deceived consumers to ‘achieve windfall profits,’ class action says

Samsung made deliberate and misleading omissions when marketing the allegedly defective laptops, in an attempt to induce consumers to buy them, avoid warranty obligations and “achieve windfall profits,” the Samsung class action alleges.

“Plaintiff and Class Members had no reasonable means of knowing that Defendant had omitted to disclose material information relating to the Class Laptops,” the Samsung class action states.

Williams claims Samsung is guilty of unjust enrichment and breach of express warranty, and in violation of the Magnuson-Moss Warranty Act, New York General Business Law and New York Uniform Commercial Code

The plaintiff is demanding a jury trial and requesting injunctive and declaratory relief along with an award of actual, compensatory, exemplary and statutory damages for herself and all class members.

A similar class action lawsuit was filed against Samsung in 2021 by a consumer arguing the company hid a known defect about its Chromebook Plus 2-in-1 portable computer from consumers.

The plaintiff is represented by Lawrence Deutsch and Jeffrey Osterwise of Berger Montague PC and Neil Grossman, Peretz Bronstein, Eitan Kimelman and Nava Listokin of Bronstein, Gewirtz & Grossman LLC.

The Samsung laptop class action lawsuit is Williams, et al. v. Samsung Electronics America, Inc., Case No. 2:23-cv-00989, in the U.S. District Court for the District of New Jersey.

  1. Carla Ferguson says:

Yes, I have experience the same thing with the overheating. I have complained to them several times and told there was a ticket number for them to get back to me in which they have not. Today I try every remedy to rectify the Issues With Them. And they refuse to help me even though I am still in the original 1 year warranty and also have extended warranty. That starts after this one is up. The computer has several defects, especially when it gets updated. It over heats while performing basic usage and the touchpad on the laptop also stop working completely. All this issues are repetitive among several consumers. And the laptop is brand new. I have a samsung galaxy book three pro 360. I would love to join the lawsuit.

  2. Andy Hollinson says:

I purchased one of these computers and have the same issues. Also the screen has repeatedly cracked for no reason without any damage. Not very impresse/

  3. Lisa Oreo says:

Please add me. Purchased 11/2022. Recently overheated until I updated drivers, but now the screen has spontaneously cracked which can and should be added due to the defect in material and workmanship. I’ve also seen several public complaints about the screen spontaneously cracking and not a result of any misuse, abuse, or physical damage to cause such a crack. Samsung states “The Samsung limited warranty covers manufacturing defects in materials or workmanship encountered in intended use of the product and shall not cover the physical damage including damage caused by accident, abuse, or misuse of the product. If this is the case, it would still need service if you want to fix it.” How are they determining it was physical damage when the laptop was closed, in no contact with any other item, and was used as intended. Their resolution to identify the issue is for me to mail them the device which will definitely cause additional damages beyond the defects of material and workmanship I witnessed. They’re forcing consumers to void the warranty as they have no viable solution to determine the defects.

    1. Lisa says:

To add, I’m assuming the updated drivers was a recent resolution that was not publicly announced either.

  4. Carolyn Mauricette says:

I purchased a Galaxy Book 2 Pro 360 in August, and it is heating up at an uncomfortable level that worries me about the longevity of the laptop. It’s now October, and I notice that when I have a reasonable number of tabs open while streaming, it gets really hot, and I can hear the fan constantly; plus, the streaming is a bit glitchy when the computer gets hot. I have the laptop elevated with airflow underneath it, but that doesn’t seem to make a difference. I got this computer because my cheaper ASUS started randomly shutting down on me eight months after I bought it. I’m really disappointed that this expensive tech isn’t living up to its performance. I really wanted to use the Samsung ecosystem because I have a Samsung phone that works fine, but this issue isn’t selling me at all, and I can’t afford to keep buying computers.
