DoubleDown Interactive agreed to a $415 million class action lawsuit settlement to resolve claims its casino mobile games violated Washington’s gambling laws.

The settlement benefits consumers who played DoubleDown Casino, DoubleDown Fort Knox, DoubleDown Classic and/or Ellen’s Road to Riches before Nov. 14, 2022.

DoubleDown Interactive is a mobile gaming developer that specializes in casino games. These games allow consumers who play casino games on their mobile devices.

According to a class action lawsuit, DoubleDown’s games violate Washington’s laws against gambling. In order to play DoubleDown Interactive casino games, users are allegedly required to use in-game “chips.” Although consumers receive a bundle of free chips upon downloading the games, consumers are allegedly forced to purchase additional chips using real money.

“Defendants’ online casino games have thrived and thousands of consumers have spent millions of dollars unwittingly playing Defendants’ unlawful games of chance,” the gambling class action lawsuit contends.

Since the game chips are purchased with real money and are used to wager for more chips, the plaintiffs contend the casino mobile apps represent illegal gambling schemes. These apps allegedly violate Washington’s gambling laws and, therefore, plaintiffs say that they are entitled to recover the illegal profits gained by DoubleDown Interactive.

DoubleDown hasn’t admitted any wrongdoing but agreed to a $415 million class action lawsuit settlement to resolve these claims.

Under the terms of the settlement, class members can receive a cash payment based on the amount they spent on in-game purchases for DoubleDown casino games, the number of claims filed and the net settlement fund after deductions. 

Class members who spent higher amounts on in-app purchases will receive larger payments. Coming soon, consumers can check the settlement website for a settlement payment estimate

Any funds remaining in the settlement after the initial round of checks and electronic payments may be used for a second distribution or donated to the Legal Foundation of Washington.

Also as part of the class action lawsuit settlement, DoubleDown Interactive has agreed to make changes to its casino applications to include information about video game behavior disorders. The games will also include a voluntary self-exclusion policy. 

The game developer has also agreed to gameplay changes that allow consumers to continue playing the apps without having to purchase additional in-game currency.

The deadline for exclusion and objection is Feb. 14, 2023. 

The final approval hearing for the settlement is scheduled for June 1, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by April 11, 2023.

    How is this diffrent than MyVEGAS app, Wynn and Caesars app? All the app is marked as 17+ but the rewards needs to be redeemed as a member which you have to be 21+ to join. I have brought this up to them multiple times and kept a good record but they don’t seems to care. Just wondering how they are different than this lawsuit ?

    I’m wondering how they determine how the payouts come, I.e. check, direct deposit , PayPal? Are they going to send letter asking us how we want to receive it?

      You had to select your payment method when you filled out the claim form. So that’s how they will know. You could not have submitted a claim without picking a payment method.

      Got paid from DoubleDown settlement through paying, claimed $100 spent on the app and received $19 from settlement by PayPal on 10/3 at 6pm

    I can not find the website I read this on but I think it was Reuters. The article stated that all distribution of all funds must be completed on or before November 4, 2023. Did any one see the article. I spoke to the administrators office on 09/07/2023 and was told that they do not know of any deadline for distribution of funds to members of this class action lawsuit.

      On the FB group someone posted that the settlement admin told them notification with payment amount will not be sent. Everyone asking is being told to use the payment estimator on the settlement website

    I’ve read several opinions on whether the Big Fish Settlement was taxable or not. Some said yes, others said no. But does anyone know what the IRS says? Was there ever an official determination by the IRS? I emailed the settlement administrator with a few questions and they responded that they would not be sending 1099s but that we need to talk to a tax professional about how to handle it. I read that the IRS REQUIRES a settlement company to send a 1099 unless the settlement qualifies for tax exception. It looks like there will be some pretty large payouts with this settlement so the tax consequences could be huge for some people. Nobody wants to pay taxes if they don’t have to, but you also don’t want to NOT pay if the money is considered taxable income by the IRS – that could cost you a lot in penalties and interest. I understand that most of us are looking at this as a refund of money spent so it shouldn’t be taxed, but the IRS doesn’t always look at things the same way!

    The settlement administrator also said that distribution will not occur before 120 days after June 1, 2023.

      Ok, you only claim money that you earned. Because this settlement is giving you back money that you had already claimed taxes on, you won’t need to do nothing. You are getting money you already had and spent and that was illegal taken for

      You won’t have to owe anything to the irs. You are getting money you spent. It’s not earned money. It’s money you earned and paid taxes on, , paid to a company, and won a lawsuit to get some of it back because of fraud. You paid all the taxes on it when you purchased the coins from double down. You don’t need to do anything expect cash the check.

    I’m not sure but I did see where someone posted on the TCA Facebook page that they had been in touch with an attorney at Edelson and had been told that emails with dollar amounts would be sent out in mid-September.
