Royal Caribbean class action lawsuit overview:
- Who: Plaintiff Zachary Kahn filed a class action lawsuit against Royal Caribbean Cruises Ltd.
- Why: Kahn claims Royal Caribbean sent misleading promotional emails to consumers in Maryland.
- Where: The Royal Caribbean class action lawsuit was removed to Maryland federal court.
A new class action lawsuit accuses Royal Caribbean Cruises of sending promotional emails to consumers in Maryland that contained misleading information about the duration of certain cruise promotions.
Plaintiff Zachary Kahn alleges Royal Caribbean sent Maryland consumers emails falsely suggesting certain cruise promotions were ending when the company actually extended them.
The complaint claims Royal Caribbean sends emails advertising Black Friday, Cyber Monday, Mega Sale, early-access, instant-savings, onboard-credit, kids-sail-free and other time-limited offers in the subject line.
Kahn alleges he received an email from Royal Caribbean on Nov. 17, 2024, with the subject line, โEarly access savings ENDS TOMORROW โ Up to $750 and more!โ which he argues falsely claimed would expire the next day.
Kahn further argues the allegedly false deadline representations โwere materialโ because they โconcerned whether recipients would lose the opportunity to obtain the advertised offer unless they acted by the stated deadline and were capable of affecting whether and when a reasonable recipient opened the email, visited RoyalCaribbean.com or made a purchasing decision.โ
Class action: Royal Caribbean violated Maryland law
Kahn argues Royal Caribbeanโs conduct violates Marylandโs Commercial Electronic Mail statute, โwhich prohibits the transmission of commercial electronic mail to an email address the sender knows or should know is held by a Maryland resident when the subject line contains false or misleading information.โ
The plaintiff claims Royal Caribbean knew or should have known its emails were reaching Maryland residents because the company is registered to do business in the state, markets cruises to Maryland consumers and keeps detailed customer data, including names, email addresses, marketing preferences and device information.
โDefendant sent, authorized, controlled, directed, benefited from or caused to be sent the commercial electronic mail messages at issue in this case,โ the Royal Caribbean class action lawsuit says.
Kahn wants to represent a class of all persons in Maryland who, within three years before the filing of the complaint, received one or more commercial electronic mail messages from Royal Caribbean containing a subject line that stated or implied that a cruise promotion was ending when it was actually extended.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for himself and all class members.
In 2025, a woman filed a class action lawsuit claiming Royal Caribbean was responsible for a former employee secretly placing hidden cameras in passengersโ rooms.
