Waggin' Train Dog Treats class action lawsuit

Nestle Purina failed in its bid to dismiss a class action lawsuit filed by dog owners who alleged their pets got sick or died from eating the Chinese-made Waggin’ Train jerky treats.

U.S. District Judge Robert Gettleman of Chicago refused to dismiss the Purina Waggin’ Train class action lawsuit, saying that the plaintiffs have provided sufficient facts to make a claim that the jerky treats were defective. The judge, however, dismissed most of the allegations against Wal-Mart, Costco, Target. BJs, CVS, Walgreens, Pet Supplies and other retailers who sold the treats.

Top Class Actions reported about the Waggin’ Train dog treat class action lawsuit last April after a grieving pet owner, Dennis Adkins, filed a $5 million class action lawsuit against Nestle and Wal-Mart after his 9-year-old Pomeranian named Cleopatra allegedly died after eating the jerky treats.

“Between March 13, 2012, and March 15, 2012, Mr. Adkins gave one of the treats to Cleopatra daily, which he chopped into two to three pieces,” the class action lawsuit states. “Immediately thereafter, Cleopatra became sick and, on March 26, 2012, died of kidney failure.”

Other plaintiffs made similar claims, but Judge Gettleman said their cases should be heard in the states where they reside.

“In the instant case, 19 out of 21 plaintiffs allege that they reside in states other than Illinois and that they purchased the chicken jerky treats and fed them to their pets in their home states. With the exception of the two plaintiffs who reside in Illinois, the complaint alleges no other facts tying any of defendants’ alleged misconduct or the plaintiffs’ alleged injuries to Illinois,” the judge said.

The Food and Drug Administration has been investigating a possible link between dog illnesses and chicken jerky treats made in China since 2007, and has urged pet owners to use caution when feeding dogs these products. The FDA even came up with an agency warning last November 2011 warning that some pet owners and veterinarians have reported cases involving dogs falling ill after eating Chinese-made chicken jerky treats.

According to the FDA’s website, the illness affects the kidneys, and symptoms include decreased activity, vomiting, diarrhea and increased water consumption and urination. Following the warning, multiple class action lawsuits were filed against numerous manufacturers of Chinese-made dog treats, including Milo’s Kitchen.

Mr. Adler is seeking compensatory and punitive damages for a class of anyone who bought Nestle Purina or Waggin’ Train-brand dog treats containing chicken imported from China in the past four years.

    My 1 1/2 old boxer died of kidney failure giving these chicken treats from china.. Whenn she was a puppy she ate a whole bag of them…I spent over 400o dollars trying to keep her alive. Its not about the money its to punish these people who where aware of the dangers.

    I had 3 dogs(pit bull, boxer and mini dachshund); my pit Sandy died in 2011, boxer Speed in 2012. I still have my mini dachshund Skittles however she has a growth on one of her nipples. I was giving them this treat in 2010 or earlier never thinking it was harmful or never knew it was made in China….it is very painful I still CRY every time I think of them they were 3 and 4 and should still be here. Please if not to late include me in this class action …..I miss my sandy and speed never would have given it to them….now skittles has a growth that happened overnight from giving her that crap. Ugh!’!!!!!!!

    I was contacted via e-mail by Purina within the last 2 weeks(02/2014) to receive these Waggin Trail treats and then after feeding them to my dog I was to log on to the website provided and give them feedback. The package states in bold letters “MADE IN USA and that they were made with REAL CHICKEN. He loves the jerky duos and now I am so frightened that they might have asked me to feed my dog poison. I am wondering if anyone else was contacted with this offer and if Purina made changes that I really didn’t feed him poison. I’m really upset over this. I actually got to see what others have written when I was asking where can I buy Waggin Traials because of the way he loves them!!! Help!!

    We lost our dog Mystic to kidney failure, due to these treats. She lost appetite and would not drink water for days after consuming the Waggin Train treats. Spent over a thousand dollars in emergency vet and regular vet visits, only to be told that there was no hope. First question they asked was whether she had been consuming the treats, as it’s common knowledge amongst those that practice vet medicine. How do I join the lawsuit for the loss of our beloved pet; the anguish caused by their negligence and the reimbursement of the money spent in vain to keep out pets alive?

    I lost my shitzu and 8 days later, my Papillion – the first with acute kidney failure and the second with sudden on-set of seizures at age 10 (neurologic issues have contributed to 10% of the adverse experiences noted). Within days of the second death the news of over 600 deaths of dogs from these treats was on the news for about 2 days. To think I could have contributed to their deaths by giving them these treats is almost unbearable. I spoke with Purina and received a letter saying their insurance company would be in touch — a month ago. No contact from insurance co. Please keep me informed on the suit.

    Not the Waggin’ Treats, but our black lab Daisy died last night after a Purina Busy Bone. So I see from another comment Sam’s Club pulled some Waggin’ Treats but not Busy Bones. I hope they understand what this is doing to families and pull all of it!
