Waggin' Train Dog Treats class action lawsuit

Nestle Purina PetCare Company and Waggin’ Train LLC have agreed to settle three class action lawsuits alleging Waggin’ Train and Canyon Creek Ranch dog treats imported from or containing ingredients from China were defective and caused some pets to become sick and/or die after they consumed the products. If you purchased or your pet consumed Waggin’ Train or Canyon Creek Ranch dog treat products, you could be entitled to benefits from the class action settlement.

The plaintiffs in the dog treat class action lawsuits blamed the nation’s largest manufacturers of jerky treats for the illness and death of more than 1,000 pets.

Nestle and Waggin’ Train deny any wrongdoing but agreed to settle the dog treat class action lawsuits to avoid the cost and expense of trial. Under the terms of the proposed dog treat settlement, the defendants have agreed to create a $6.5 million settlement fund to reimburse eligible Class Members for reasonable economic damages incurred as a result of their pet’s consumption of the dog treat products. The companies have also agreed to change some of their policies related to the ingredients and labeling used for its dog treat products.

UPDATE: An appeal to the dog treat class action settlement was dismissed on Dec. 10, 2015, meaning that checks may soon be mailed to Class Members who filed valid claims.

UPDATE 2: On Mar. 21, 2016, Top Class Actions readers started receiving checks in the mail from this class action settlement worth as much as $300.

Who’s Eligible

You are a Class Member of the dog treat settlement if you purchased or obtained, or if your pets used or consumed, Waggin’ Train or Canyon Creek Ranch dog treat products imported from China or containing any ingredient imported from China.

Eligible Class Members may receive up to a 100 percent cash payment for documented, reasonable economic damages incurred as a result of their purchase or their pet’s consumption of the dog treat products, including veterinary treatment costs, death-related expenses and reimbursement for the cost or fair market value of their deceased pet.

Class Members who do not have documents supporting their claims for economic damages may be eligible for cash reimbursement of up to $300 per pet.

The claims may be subject to pro rata reductions and other limitations:

  • The total amount of money available to reimburse pet owners for healthy pet screening or testing in cases where the pet did not become ill or die is limited to a total of $100,000.
  • The total amount of money available for reimbursement of purchases of dog treat products is limited to $700,000.
  • If the total value of claims for all other economic damages exceed the total class action settlement fund available, the claims may be subject to a pro rata reduction.
Proof of Purchase

Dog Treat Purchase: Documentation of dog treat product purchase may include receipts, credit card statements, cancelled checks, copies of the product labels or any other records that demonstrate you purchased the food and how much you paid.

Veterinary Expenses: Documentation of veterinary expenses may include veterinarian bills, veterinarian records, cancelled checks, receipts, credit card receipts or statements, or a statement from your veterinarian.

Death-Related Expenses: Death-related expenses may include the costs of euthanasia or putting your pet to sleep, necropsy or pet autopsy, cremation, burial or other services. Documentation of these expenses may include veterinarian bills, veterinarian records, pet cemetery records, cancelled checks, receipts, credit card receipts or statements, or a statement from your veterinarian.

Loss of Pet: Documentation of expenses for the loss of a pet may include a bill, receipt, credit card statement, cancelled check, AKC or CKC registration, third party appraisal or other documentation of the cost or fair market value of the pet.

Even if you do not have documentation to support your claim for economic damages, you may still be able to receive payment for valid and reasonable economic damages, up to a maximum of $300.

    I just came across this notice dated 10/2/15. Put it somewhere safe ( obviously ). I had to put my pug to sleep on 8.8.15 never received anything from these murderers.
    Just tried calling and emailing them both no longer in service ?

    Omhgggg only got 76 dollars.. my poor dead babies died from their food. I dont believe this! ! Good Lord whats going on?. What happened to the money I was promised? .. God don’t like ugly!!

    I look at people getting 3k check and two household clamina for vet bills for dogs and getting 2-3 checks totaling damn near 5k and claims were approved for sick dogs….for people that filed claims with multiple pets or dead pets and they got little to nothing. ..I agree the funds were mishandled for sure

    Three vet bills and have a bill on my credit for my dog that totaling $1300 and I got a litte over $300 they claim they will give you fair market value for your pet plus treat and vet bills but they lied

    So i got a response. Only thing is when i calle i got a very nice woman gave her my claim id number she could not find any information on my claim so now we wait for the research dept to cal me back. But this is what everyone woth a problem needs to do if they want answers i suggest u call too. Hello Ms. Lupi,

    I’m guys so I got in touch with the settlement claimants council for the lawsuit a Mr. Stuaŕ Davidson I reached out to them #1 to let them know what we have been experiencing someone needed to know what was and is going on with the check amounts and of the non recieving checks I explained everything but was just asking for a contact number of possible. Or a way to get in touch with the class action administrator. He replied back and have me the same number I had already had. So I replied back and thanked him for his day response and explained this is the number I have already but thanked him just the same. I sent this to him then realized I had another question and sent a new email to him asking if possibly the court and or judge who heard the case may have maybe another possible way to contact the claims administrators office. I sent the text. I recieved another email from him he is going to email the claims administrator and have them contact me via email as a way of comunication. Well thank god. Finally I will let all know what the out come is and keep you all posted. Promise…..

    Could we all possibly get a hold of the lawyers and or council/judge to report lack of monatary payments and percentages paid out. There has to be someone we could all report this too. At first I thought maybe this was just us. Even though we submitted all bills telephone numbers to vet/ hospital. And forget me knots crematorium company that handled services of burial for our pets however seeing all of you people and the broad spectrium of payments and ratios i think honestly there were obviously big mistake made with the settlement percentages paid out. One person pays 2300 in vet bills recieved 1300 settlement another almost the same amount recieved what was it 55.00 and change. Something does not seem right an I wonder if this settlement administration company mishandled the funds. I have now sent them two emails in a week’s time questioning my check amount recieved way before I read all of these statements. And I have not even recieved a call or a response via email back even just a courtesy email saying we have recieved your email. Tired calling as well just an automated service no one answering. Very upset for my self and for all the others out there and in this site in the same position as myself and my children.
