Unqualified Driver allegedly Causes Swift Truck AccidentA Swift truck accident lawsuit was recently filed after a woman reportedly sustained serious injuries which allegedly were caused by the negligent actions of the company’s truck driver.

The Swift truck accident lawsuit alleges the driver lacked the required training and driver’s license to operate the truck but still chose to drive the 18 wheeler which collided with the claimant’s car.

Plaintiff Estefina A. filed this Swift truck accident lawsuit soon after the incident. She says she later discovered that the driver was allegedly under the influence. The personal injury claim names Swift Transportation Company of Arizona, LLC and driver Cindy S. as defendants, and alleges the driver’s actions are directly responsible for the Swift truck accident.

According to the Swift truck accident lawsuit, Estefina had been driving her vehicle in the eastbound middle lane on the service road of ERL Thornton Freeway. During this time, Estefina says she followed all driving safety rules and precautions and had no reason to believe she was at risk for any serious vehicular accidents.

Overview of Swift Truck Accident Lawsuit

According to the Swift truck accident lawsuit, on Aug. 9, 2016, Estefina tried to turn left onto westbound N. Jim Miller Road but instead collided with the Swift truck.

The driver of the truck reportedly turned too wide and crossed over into Estefina’s lane, which she says caused the Swift truck accident to occur. Not only was Estefina seriously injured, but her car suffered serious damages.

Estefina claims the driver was reportedly aware that the size and weight of the truck could cause potentially fatal harm to other drivers, but allegedly acted negligently regardless of that knowledge.

It is important to note that 18 wheeler trucks require a Class A commercial’s driver’s license, but Estefina says the driver allegedly lacked this qualification. In addition, the driver reportedly took measures to hide this fact but was later discovered.

She had been trained by Swift Transportation Company and had to meet the required deadline and other occupational duties required by the corporation. Estefina argues Swift Transportation Company should have confirmed that the driver was properly trained to operate their semi truck, and that she had the required driver’s license.

The Swift truck accident lawsuit alleges that this accident could have been prevented had the driver been properly trained and licensed and if Swift Transportation Company had taken the time to confirm this information. This Swift truck accident is one of many incidents that occur throughout the country, involving large semi trucks.

There are approximately 500,000 truck accidents that occur every year in the United States, with 5,000 of these incidents being fatal and over 100,000 involving serious injuries.

While there are factors like weather that are beyond the driver’s control, there are a number of different factors that can cause a truck accident including:

Estefina alleges that as a direct result of the driver’s negligent driving, she suffered serious injuries and has had to undergo an intensive recovery process.

Estefina says she has suffered diminished quality of life and has been forced to miss work due to her injuries, while incurring massive medical bills. Estefina is seeking compensation for all relevant damages from the Swift Transportation Company, with the claim citing multiple counts of negligence.
