A Tennessee man recently added to the growing pile of Monsanto litigation by hitting the company with yet another Roundup weed killer lawsuit.
According to the Roundup weed killer lawsuit, Roundup is “defective” and “dangerous to human health.” Further, alleges the plaintiff, consumers were not given adequate warning about its dangers. The plaintiff’s injuries, along with the injuries of thousands of other Roundup users, could have been avoided, the Roundup weed killer lawsuit claims. Instead, Monsanto chose to conceal these risks, placing consumers in danger.
The plaintiff, Larry R., alleges that he was diagnosed with Non-Hodgkin’s Lymphoma in 2014 as a direct result of his continued exposure to the weed killer Roundup.
The Roundup weed killer lawsuit was filed on multiple counts, including design defect, failure to warn, negligence, and several others. The lawsuit was filed on March 29, 2018 in the U.S. District Court for the Eastern District of Missouri.
Roundup Weed Killer Linked with Cancer
A growing number of plaintiffs, including farm workers and home gardeners, are filing lawsuits against Monsanto, alleging that they were diagnosed with cancer as a result of exposure to the product and its key ingredient, glyphosate. Several kinds of cancer have been linked with exposure to Roundup.
The Environmental Protection Agency began to suspect a connection between Roundup and cancer since the 1980s. A recent report published in March 2015 by the International Agency for Research on Cancer (IARC) concluded that glyphosate, the active ingredient in Roundup, is linked with cancer.
Types of cancer that have so far been linked with the weedkiller include Non-Hodgkin’s lymphoma, leukemia, Bone cancer, B-cell lymphoma, multiple Myeloma, Renal Cell Carcinoma, and many others.
Lawsuits allege that Monsanto misrepresented the actual safety of its weed killer product, downplaying the risks when it was actually aware of the cancer link. Monsanto has gone so far as to use the taglines “safer than table salt” and “practically non-toxic” to animals to describe its product, despite allegedly being aware that the risk is much greater. In 1996 New York Attorney General filed a lawsuit against Monsanto for making these kinds of statements, claiming they were deceptive and dangerous to customers, misleading them about the actual safety of the product.
Filing a Roundup Weed Killer Lawsuit
Larry’s Roundup weed killer lawsuit alleges that his injuries are not unique. There are thousands of other Roundup users in similar situations whose subsequent diagnoses with cancer were avoidable with the proper warnings for use.
If you are one of the countless people who use Roundup, either in the course of your employment or for your home garden, and have since been diagnosed with Non-Hodgkin’s Lymphoma or another cancer, you may be able to file a Roundup weed killer lawsuit.
While filing a lawsuit cannot take away the pain and suffering caused by Roundup-related cancer or bring a loved one back to life, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Roundup Weed Killer Lawsuit is Case No. 4:18-cv-00470-CDP, in the U.S. District Court for the Eastern Division of the Eastern District of Missouri.
If you or a loved one developed cancer after using Roundup as a farm worker or home gardener, you may have a legal claim. Legal migrant farm workers may also seek help. Learn more by filling out the form on this page for a FREE case evaluation.
