A Kansas woman has filed a product liability claim alleging Monsanto Roundup weedkiller caused her to develop non-Hodgkin’s lymphoma.
According to the Roundup cancer lawsuit, plaintiff Beverly K. used Monsanto Roundup weedkiller on a regular basis and had been exposed to the chemicals in it. This exposure allegedly resulted in the development of non-Hodgkin’s lymphoma.
According to the Roundup cancer lawsuit, Beverly began using Monsanto Roundup in 1975 and used it on a regular basis. During all times relevant, Beverly says she followed all instructions and did not use the product outside of its intended use. Even with this diligence, Beverly had developed and was diagnosed with non-Hodgkin’s lymphoma.
Beverly opted to file legal action soon after her diagnosi after discovering that her disease could be related to Monsanto Roundup weedkiller. She further alleges the company had known about their product’s alleged link to cancer since the 1980s, with the EPA concerned over the main ingredient of Monsanto Roundup. The EPA had stated that glyphosate was a possible carcinogen on March 4, 1985, with researchers calling for further study.
Overview of Monsanto Roundup Cancer
The active ingredient of Monsanto Roundup is glyphosate, which is a broad spectrum herbicide used to kill weeds and grasses around crops. Glyphosate is a “non-selective” herbicide, which means it kills any organism if it produces the enzyme 5-enolpyruvylshikimic acid-3-phosphate synthase (EPSP synthase).
Monsanto Roundup is one of the most popular weedkillers in the United States and is used all over the world. However, glyphosate has been linked to a number of serious cancers and has been designated a probable human carcinogen by the International Agency for Research on Cancer (IARC) in March 2015.
During this time, the IARC had released a report consisting of three different studies indicating a strong link between glyphosate and non-Hodgkin’s lymphoma. These studies were published in the United States, Canada, and Sweden beginning all the way back in 2001:
- The Canadian study was published by the American Association for Cancer Research, which found subjects exposed to glyphosate were developing non-Hodgkin’s lymphoma after being exposed for 10 years.
- The United States study was published in the Occupational and Environmental Medicine journal, which concluded that glyphosate and certain other pesticides were “potentially carcinogenic” and were strongly associated with non-Hodgkin’s lymphoma.
- The Swedish Study was published in the International Journal of Cancer, which found that the risk of non-Hodgkin’s lymphoma doubled after less than 10 years after glyphosate exposure.
The IARC report had also reportedly found carcinogenic properties in four other pesticides.
Even though the risk of cancer was well documented with glyphosate, the product label of Monsanto Roundup allegedly failed to mention this. At all times relevant, Beverly says she did not receive any warnings or notifications from the company and was not notified of the potential carcinogenic risks.
Beverly states she would not have used Monsanto Roundup if she had known the alleged link with cancer. Beverly is filing this Roundup cancer lawsuit raising multiple claims, including negligence and failure to warn.
