Pfizer securities lawsuitPfizer Inc. has agreed to a $190 million class action settlement that, if approved, would resolve claims that it delayed generic versions of its epilepsy drug Neurontin and promoted it for unapproved uses.

The class action lawsuit was initially filed more than a decade ago by direct purchasers of Neurontin. The plaintiffs alleged that Pfizer violated the Sherman Act by maintaining a its monopoly power with respect to gabapentin anhydrous, which it sold under the brand name Neurontin, and effectively delayed competition from generic versions of the drug through a multi-faceted scheme.

According to the Neurontin class action lawsuit, Pfizer engaged in illegal off-label promotion, manipulated the patent application process, filed bogus patent lawsuits and engaged in fraud. As a result of Pfizer’s allegedly illegal actions, the direct purchasers claim they were forced to pay artificially inflated prices for the epilepsy drug.

In 2004, Pfizer pleaded guilty to criminal charges of illegally marketing Neurontin and agreed to pay $430 million following an investigation by the U.S. Justice Department.

On Jan. 25, 2011, the court certified a class consisting of: “All persons or entities in the United States that purchased Neurontin from Pfizer at any time during the period of December 11, 2002 through August 31, 2008 and who have purchased generic gabapentin.” Louisiana Wholesale Drug Company Inc., Meijer Inc. and Meijer Distribution Inc. were appointed to represent the members of the Neurontin class action lawsuit.

On Monday, Louisiana Wholesale and Meijer filed a motion requesting the preliminary approval of the Pfizer Neurontin class action settlement. They claim that the settlement was reached after “intensive arms’-length negotiations, including multiple mediation sessions held with a skilled mediator,” as well as substantial discovery.

Under the terms of the Neurontin class action settlement, Pfizer will pay $190 million in cash, plus interest, to the plaintiffs and Class Members in exchange for dismissal of the litigation.

Pfizer has denied any wrongdoing, but agreed to settle the Neurontin class action lawsuit to put an end to the lengthy litigation process. In a statement, Pfizer said that the class action settlement “reflects a desire by the company to concentrate on its business and the needs of patients and prescribers, while also reducing the cost and distraction of prolonged litigation.”

The direct purchaser plaintiffs are represented by Jonathan D. Clemente of Clemente Mueller PA, Bruce E. Gerstein of Garwin Gerstein & Fisher LLP and Richard J. Kilsheimer and Robert N. Kaplan of Kaplan Fox & Kilsheimer LLP.

    I was on Gabapentin for years for fibromyalgia and arthritis. I kept telling my doctor my hair was falling out because of it. He wouldn’t listen and finally I told him I’m going to start taking it after years of use in the progressing lots of hair slow down. Please add me to the list

    I was perscribed gabapentin 2/25/2021 100mg at 3 bottles of 270 count for anxiety as needed i ended up not taking them because everytime i did i would forget to do things and i would be wiped out, i slowly weened myself off of them because i also didnt want to get an addiction

    I was on Neurontin/gabapentin from 2002 – 2013 if I remember correctly. My entire life has changed because of this drug. I was once happy and a go getter now I hide in the home and worry what will go wrong, at any time in the day or even at any minute of the day. I have been diagnosed with posttraumatic stress disorder, chronic with bipolar 1 disorder, moderate with anxious distress. I have a daily struggle to keep calm and I often have a hard time remember stuff said to me within 5 minutes. Their are many other things I can tell you over the phone. When I first started taking this drug I put a loaded gun in my mouth for about 15 minutes thinking if I should pull the trigger and also gave the gun to another person asking the to kill me. I was normal before this drug and without a police record and now this has all changed. It was given to me for pain management and not how it was allow to be used for, and now I even see new side-affects versus what I have seen. I take Lithium carbonate, sertraline HCL, and prazosin HCL, this helps, but not a cure. This is what I take if order to have some kind of life when going out into public these days, if I do not take these meds I get into altercations with other people. I have a hard time recognize social cues, also I feel easily manipulated by others and they treat me poorly, I cannot predict how my actions are sometimes because of Neurontin/Gabapentin with is a very dangerous drug for any person regardless of situation. The had me taking three, 300 mg, 3 times a day. Please someone help me file for a claim.

    Gabapentin 300mg 2 in the morning, and 2 in the evening. I have taken Gabapentin during the time
    frame listed above, and I have given you the daily usage that I still take every day. Wow………..
