Pennsylvania Woman Alleges Company’s Negligence Led to Mesothelioma

Plaintiff Jamie Brown used and was surrounded by products constructed by Pfizer Inc. that led to her recent diagnosis of mesothelioma, according to an asbestos exposure lawsuit recently transferred to U.S. District Court in Pennsylvania.
Brown, a resident of Pennsylvania’s Lehigh Valley, alleges a number of different locations where she was exposed to the insulating material that can lead to lung cancer because of its fibrous construction. Specifically, she and her mesothelioma lawsuit lawyer said she ingested asbestos fibers during activities in the following locations:
1) As a relative visiting family members at Bethlehem Steel and New Jersey Zinc beginning in 1970.
2) Beginning in the mid-1970s, she allegedly used hair care products and dryers that also contained asbestos.
3) During the 1980s, Ms. Brown worked as a seamstress for two companies where she came into contact with products made by a Pfizer Inc. subsidiary.
Due to the use of a master short-form complaint, further allegations are not included in the woman’s complaint. However, her mesothelioma lawsuit lawyer is seeking compensatory and punitive damages of more than $50,000 each. While the complaint cited an appeals court decision ruling that plaintiffs like Brown could file lawsuits in Pennsylvania state court, Pfizer Inc. successfully filed a motion to remove it to district court.
The two reasons given by the judge in ordering the transfer is the diversity in jurisdiction, as Pfizer headquarters are located in New York, and that the amount in question totals more than $75,000. Brown’s case is just one of thousands currently pending against multiple manufacturers who allegedly knew of the risks regarding asbestos and lung cancer for decades, but continued to make products that included the insulation material.
The asbestos exposure lawsuit is Jamie L. Brown v. Pfizer Inc., Case No. 13-cv-05785, in the U.S. District Court for the Eastern District of Pennsylvania.
