Plaintiff David K. has filed a lawsuit in Missouri federal court against the Monsanto Company alleging that he suffered serious adverse effects from using the company’s weed killer product, Roundup.
According to the Monsanto cancer lawsuit, he maintains that Roundup and its active ingredient glyphosate are dangerous to human health. David also claims Roundup is “unsuitable to be marketed and sold in commerce, and lacked proper warnings and directions as to the dangers associated with its use.”
The Monsanto cancer lawsuit alleges that the plaintiff’s injuries are like those suffered by thousands of similarly situated victims across the country.
The Monsanto cancer lawsuit purports that David is a resident and citizen of Ogle County, Il. He files the Roundup lawsuit because of personal injuries he allegedly suffered do to his exposure to Roundup, a product containing the active ingredient glyphosate and the surfactant polyethoxylated tallow amine (POEA).
The Monsanto cancer lawsuit iterates that he developed non-Hodgkin’s lymphoma due to his exposure to Roundup.
According to the American Cancer Society, non-Hodgkin’s lymphoma is a cancer that begins in the white blood cells, which are called lymphocytes. Lymphocytes are part of the body’s immune system.
The Monsanto cancer lawsuit claims that the Monsanto company has long misrepresented Roundup products as being safe for people to use, even though the company allegedly knew otherwise. Roundup advertisements used taglines such as “safer than table salt” and “practically non-toxic”.
However, according to David’s Monsanto cancer lawsuit, these claims are not true. David alleges that in fact the product is dangerous for use and for human health due to the alleged adverse effects that the product may cause, such as non-Hodgkin’s lymphoma.
The Monsanto cancer lawsuit is filed on multiple counts, including negligence, strict products liability-design defect, strict products liability-failure to warn, breach of implied warranties, breach of expressed warranty.
Monsanto Cancer Lawsuit Basics
The popular Roundup weedkiller has been purportedly associated with causing a number of serious Roundup cancers, including non-Hodgkin’s lymphoma. The types of cancers that have been thus far linked to the Roundup product include but are not limited to the following: leukemia, bone cancer, B-cell lymphoma, multiple myeloma, renal cell carcinoma, non-Hodgkin’s lymphoma, and other cancers.
Moreover, among the groups most at risk for developing these types of cancer due to Roundup include farm workers and even home gardeners.
The Monsanto cancer lawsuit iterates that the International Agency for Research on Cancer, which is a “specialized intergovernmental cancer agency the World Health Organization (WHO) of the United Nations tasked with conducting and coordinating research into the causes of cancer,” has stated their conclusions based on studies of the product.
The organization says that clinical tests and studies on the product’s active ingredient, glyphosate, confirm that glyphosate is in fact a Class 2A “probable carcinogen.”
The Monsanto Cancer Lawsuit is Case No. 4:17-cv-02378-JAR, in the U.S. District Court for the Eastern District of Missouri.
