Recent reports indicate that nearly 1,500 Syngenta lawsuits have been consolidated into a multidistrict litigation (MDL), surprising many with how quickly farmers are joining the MDL. MDLs are commonly used when multiple plaintiffs file lawsuits for the same reasons, as with the Syngenta lawsuits farmers are filing over GMO corn seed.
At issue is Syngenta’s genetically modified corn seed called MIR162, or Viptera. MIR162 includes a trait that is supposed to fight insects and pests that normally disturb corn seed.
Starting in 2010, Syngenta sold the MIR162 seed to farmers across America. In 2010, Syngenta was also seeking Chinese approval to sell the genetically modified corn, meaning Syngenta sold the seed to U.S. farmers without first receiving approval from major countries who buy U.S. corn, such as China. TheSyngenta lawsuits claim that the company misled farmers into believing that Chinese approval was imminent, and that the farmers’ profits would be secured.
While China failed to grant Viptera approval, farmers across the United States had already planted MIR162 corn seed. China rejected any shipment of US corn that contained even a trace of the GMO corn seed. Even crops that were planted with corn seeds not created by Syngenta suffered from major financial hits as Viptera allegedly contaminated other corn crops as well.
Syngenta Lawsuits
Syngenta lawsuits claim that the company took a huge risk when they distributed their product before it was approved by importing countries. It was a risk that did not pay off. Hundreds of thousands of individuals involved in the corn export industry, from farmers to shippers, suffered financial losses due to the rejection of U.S. corn crops by China and other countries.
So far, close to 1,500 Syngenta lawsuits have been filed against the company and consolidated in the MDL In Re: Syngenta AG MIR162 Corn Litigation (MDL No. 2591). Plaintiffs may be people from any state in the United States who were harmed by “Syngenta’s decision to commercialize the MIR162 genetically modified corn trait in the absence of Chinese approval to import corn with that trait.”
It is likely that Syngenta lawsuits will continue to be filed against the company as proceedings continue.
