Infiniti dealership logo standNissan was hit with a class action alleging a serious defect in Infiniti brand vehicles causes the paint to delaminate and peel.

Lead plaintiff John Anglin alleges in his class action lawsuit that Nissan uses severely defective paint on Infiniti vehicles that not only peels, but can also cause rust and other damage to the vehicles’ metal body.

Further, says the plaintiff, the damage often occurs after the warranty period on the vehicle expires and Nissan refuses to fix the damage.

Anglin alleges that he purchased a white 2011 Infiniti at a dealership that cost nearly $73,000. However, shortly after his purchase in 2016, the paint began peeling, so much so that, according to the plaintiff, his vehicle looked grey. The plaintiff says he told both the dealership and Nissan about the problem, but they refused to do anything about it.

“Unlike tires, batteries, and engine oil, which need regular replacement, in modern vehicles, particularly luxury vehicles, automobile paint is expected to last the lifetime of the vehicle, such that, absent an accident, a vehicle owner reasonably would not expect to have to spend thousands of dollars to have their vehicle stripped and repainted during the ownership of the car,” alleges the Nissan class action complaint.

According to the class action, Infiniti vehicles are marketed as luxury cars and owners “receive ‘an unprecedented commitment to professionalism and customer service that is tailored to fit you and your individual needs,’” per Nissan marketing. At the time of manufacture, alleges the plaintiff, the factory applied defective paint; however, the defect was latent and not apparent to consumers when they decided to purchase an Infiniti.

The plaintiff alleges that Nissan is aware of the latent defect in the paint and has been subject to numerous customer complaints. Even while the plaintiff was contacting the dealership and Nissan customer service, continues the plaintiff, Nissan was aware of the problem, but denied it and refused to help Infiniti owners affected by the peeling paint.

“The paint on Plaintiff’s vehicle, as well as other Infiniti brand vehicles purchased by consumers, did not conform to industry standards, particularly given the luxury status and relatively new age of the vehicle,” alleges the complaint.

The plaintiff seeks to represent a nationwide Class of consumers who purchased new Nissan Infiniti brand vehicles with defective paint, along with an Illinois subclass. The class action lawsuit alleges that Nissan was negligent, violated the Magnuson-Moss Warranty Act, breached implied warranties and contracts, and violated Illinois consumer protection laws.

The class action lawsuit is seeking damages, a constructive trust against Nissan on behalf of the proposed Class, and an injunction from selling vehicles with defective paint along with attorneys’ fees.

    We bought a used 2012 Infinity QX56 with white pearl paint from a Nissan dealership and they failed to disclose the paint recall! Not even 2 years later the paint is completely gone from the hood, roof, and back of the car! I never would have thought to look into recalls or class action lawsuits. Expensive lesson learned!

    I have a 2017 Pearl white Infiniti QX30 and the paint on the front bumper is peeling like crazy. There is so much missing it looks ridiculous. I cannot believe this is an Infiniti.

    We bought a 2014 Infiniti QX80 brand new with white pearl paint. After a few years bubbling and peeling paint on the hood and around the windshield and roof. Now starting to rust. Dealership said they couldn’t do anything cause no open recalls. Infiniti said they couldn’t do anything cause no open recalls. We never received any notifications about class action lawsuits. I’m continuing to call consumer affairs in hopes to get some assistance or guidance. Please let me know if there is any other actions we can take.

    I bought a 2018 Black Nissan Pathfinder from Don Hatton in Derby Ks. I have had the car year and noticed after having it about 7months small spots of the clear coat peeling off. I called the dealership and was told I would have to repair this myself. I am so disappointed because this is the first new vehicle I’ve purchased and now have to pay for paint repair.

    Reading all of these comments, I think we probably have enough people to reopen another class action lawsuit.

    I too have a 2013 QX56 where the paint is peeling and flaking off over the entire truck. I wasn’t aware of a lawsuit until recently. I was told that Infiniti should have sent me a letter informing me of the problem, but that never happened.

      I’ve never received any notice from Infiniti, I have a 2015 QX80 Ltd. that has peeling and bubbling paint.

    I too have problems and would like to join or reopen this class action that I was not aware of. I have a red 2016 Nissan Rogue with paint peeling off all over car and the top rack is rusting peeled off!

    I have a black 2015 Infiniti Q50. I had it less than a year when white pitt marks appeared on the front left bumper. I called the dealerships attention to it. At first they tried to touch it up and then they said the pitting was too extendive to touch up.on subsequent visits. The pitting has gotten increasingly worse but Infiniti won’t do anything about it. The clear coat on the hood is also beginning to peal. How do I join a class action suit?

    Is there a way to reopen this claim? I have a 2012 that I purchased in 2019 that have this same issue with peeling paint that started 2020. Infinity want almost $10,000.00 to repaint the truck.

      I have a 2015 Qx80 Ltd. that I bought brand new, and I also have a big paint peeling problem on the hood of my vehice, and bubbling up on a couple of other areas. Can anyone please tell me if there is a claim for this vehicle.
