Infiniti dealership logo standNissan was hit with a class action alleging a serious defect in Infiniti brand vehicles causes the paint to delaminate and peel.

Lead plaintiff John Anglin alleges in his class action lawsuit that Nissan uses severely defective paint on Infiniti vehicles that not only peels, but can also cause rust and other damage to the vehicles’ metal body.

Further, says the plaintiff, the damage often occurs after the warranty period on the vehicle expires and Nissan refuses to fix the damage.

Anglin alleges that he purchased a white 2011 Infiniti at a dealership that cost nearly $73,000. However, shortly after his purchase in 2016, the paint began peeling, so much so that, according to the plaintiff, his vehicle looked grey. The plaintiff says he told both the dealership and Nissan about the problem, but they refused to do anything about it.

“Unlike tires, batteries, and engine oil, which need regular replacement, in modern vehicles, particularly luxury vehicles, automobile paint is expected to last the lifetime of the vehicle, such that, absent an accident, a vehicle owner reasonably would not expect to have to spend thousands of dollars to have their vehicle stripped and repainted during the ownership of the car,” alleges the Nissan class action complaint.

According to the class action, Infiniti vehicles are marketed as luxury cars and owners “receive ‘an unprecedented commitment to professionalism and customer service that is tailored to fit you and your individual needs,’” per Nissan marketing. At the time of manufacture, alleges the plaintiff, the factory applied defective paint; however, the defect was latent and not apparent to consumers when they decided to purchase an Infiniti.

The plaintiff alleges that Nissan is aware of the latent defect in the paint and has been subject to numerous customer complaints. Even while the plaintiff was contacting the dealership and Nissan customer service, continues the plaintiff, Nissan was aware of the problem, but denied it and refused to help Infiniti owners affected by the peeling paint.

“The paint on Plaintiff’s vehicle, as well as other Infiniti brand vehicles purchased by consumers, did not conform to industry standards, particularly given the luxury status and relatively new age of the vehicle,” alleges the complaint.

The plaintiff seeks to represent a nationwide Class of consumers who purchased new Nissan Infiniti brand vehicles with defective paint, along with an Illinois subclass. The class action lawsuit alleges that Nissan was negligent, violated the Magnuson-Moss Warranty Act, breached implied warranties and contracts, and violated Illinois consumer protection laws.

The class action lawsuit is seeking damages, a constructive trust against Nissan on behalf of the proposed Class, and an injunction from selling vehicles with defective paint along with attorneys’ fees.

Anglin is represented by David L. Gerbie, Myles McGuire and Eugene Y. Turin of McGuire Law PC.

    I have a 2011 Nissan Quest pearl white Hood and hatchback paint is peeling really bad. Can’t wash it without the paint coming off.can’t drive it without the paint coming off the front of the hood. I love my van but it’s embarrassing with the paint coming off.

      I have a 2011 Nissan Quest. White in color. The paint is peeling on the hood and the back part of the van. Today i was driving and a round piece of paint was flapping in the wind but quickly flew off. It was the paint.
      There are two other white Nissan vans in my city that I have also noticed the same thing. It is embarrassing because I love my van

      I have 2011 Quest and the white paint around the tailgate under the wind shield peeled off pretty bad. The roof where it meet tailgate peeled off as well. Dealer said they can’t do anything about it.

    I own a pearl white 2013 Nissan Rogue and the paint on the hood and sides is a huge disgusting problem. The offer they gave me for a trade is as much as a paint job would cost. I also had latent transmission problems latent after the warranty expired. Cost me thousands of dollars to fix.

    My black 2010 Nissan Altima roof has experienced complete clear coat failure and now has huge rust spots. The hoods clear coat has completely failed as well, but no rust yet. Nissan dealership where I purchased the car many years ago won’t help.

    Paint estimate is $6,800. Car is a complete loss. I can’t sell it. It has less than 130k miles on it and is in otherwise good shape.

      Have a 2013 Nissan Altima pearl white look brand new went to dealership two weeks ago got a oil change they give me a complimentary car wash went out to wash it today and started spraying it with the water hose and the paint started bubbling up on it I’m like what is going on the water went right through the paint and started blowing bubbles on it call Nissan told me to bring the car up there and look at it they didn’t look at it they just got the VIN number and said you don’t have no warranty for that on here Zedd a body shop handles the car did Arlen the class-action website was located somewhere go talk to them went and talked to them and they said yeah your whole car is going to start doing it looks just like the cars that we’re working on here from the class action lawsuit gets already approved for Infinities and Rogues this is the same problem call Nissan said they was nothing they could do it looks brand new to I sprayed it with the water hose and I washed it and washed it and never had no problem but it went to that car wash there and I was wondering if like the wind blowing on it wrinkled metal in the paint cause the pain to pop loose or something I don’t know but they want $1,000 just to paint the small little roof around skylight but said did Mark if car eventually with all do that from what they have seen add me to any list of any lawsuit her cuz the car is only got 60,000 miles on it

    I will do anything I can to support a class-action suit against this company. I have taken it to multiple dealers and they don’t accept responsibility for it.The transmission went bad very early and they would pay nothing toward that repair. The paint has peeled and I simply can’t afford to just trade the car (trade-in value has been seriously affected by the paint job). They obviously do not care about repeat customers.

    I have had mine painted b4 and infinity service made mistake of telling me all about qx56 problem that year that. So when a small piece 2 months after purchasing I ask them to take care of it and the didn’t want to but he admitted it to my. They had t blended in a one spot and i paid $500 and they pd $700. I paid it off 6 months ago and thanksgiving on interstate a high piece in a different spot flew off. I want it repainted. Is that an option

    2015 & 2017 QX80 both grey and both got paint bubbles on the rear hatch. 2017 has 15000 km in it when I noticed 3 bubbles. I pointed it out on the 2015 to the dealership and they said it was a paint chip that caused it to bubble and rust. Interesting how it was the tail gate only and in multiple places and now it’s happening on the 2017 the identical way. I’m waiting to hear back on the 2017 if they will do anything as it only went into service March 2018.

    Dear sir or madam,

    I purchased my Nissan Murano in 2013 from Bill Gatton Nissan in Bristol, Tennessee, paying approximately $40,000 for the vehicle. At approximately 60,000 miles, I had to replace the transmission because Nissan does not manufacture repair parts for these transmissions. At around 60,000 miles I noticed that the paint was cracking and flaking off. It would simply blow off as I drove. It started on the hood and has since spread over almost the entire vehicle. I thought at first that I might be experiencing rock chips, but I soon noticed that the cracks would show up in very out of the way places like inside the edge of the doors. I took this vehicle to a body shop in Kingsport, TN and was told that the problem was simply bad paint and that Nissan should be willing to stand behind this job.

    I took the car to the dealer and was told that Nissan would do nothing about this. Even at 60,000 miles, they felt no responsibility for the defect. Since that time, I have gone to two other dealers (Wallace Nissan in Kingsport, Tenn. and Grand Strand Nissan in Myrtle Beach, South Carolina). In each case, they have taken pictures and they then contacted Nissan only to be told that Nissan would do nothing to support this claim. I have called the Nissan Corporate Customer Service folks twice, only to be told to take the complaint to my dealer. In each case, I have gone to the dealer only to be told again that Nissan would simply not discuss the problem.

    I travel almost every week as I sell products to the tire and rubber industry. I now have 265,000 miles on this vehicle and the paint has peeled from almost every surface on the car. A spot will simply appear and, over time, it will grow and the paint will simply fall off. As I depend on this vehicle to earn a living, it is serviced by the dealer every 6,000 miles and repair that are needed are completed immediately. The dealer in Myrtle Beach is very apologetic every time I go in for service, but he knows that there is nothing that he can do to help.

    I will do anything I can to support a class-action suit against this company. The transmission went bad very early and they would pay nothing toward that repair. The paint has peeled and I simply can’t afford to just trade the car (trade-in value has been seriously affected by the paint job). I am 76 years old, still traveling every week and very honestly cannot believe the attitude of the Nissan corporation toward their customers. They obviously do not care about repeat customers.

    I would appreciate any help you might offer.

      The paint is peeling off my 2014 Nissan Murano I contacted nissan they refuse to be of any assistance due to having no warranty, what can I do?

    I have a 2011 Infinti QX56 and my paint is almost completely gone from the roof and the hood. It looks horrible and the quote for a repaint is $3600..00 I am embarrassed to drive it and very upset with Infinti/Nissan for not just doing the right thing and doing a paint recall

      I paid to get the truck paint over first now the whole car need to be paint the original paint just peel like a orange and it black the paint is no good on my 1011 Infinixty g37 And my car only go 80000 miles on the car

      There is an existing class action suit that has been settled and if you go to Infiniti Consumer Affairs or call them they will ask for your VIN and give you advice to call the suit administrators. The bottom line for them is that the settlement gives you an extended warranty. If you have a 2009 – 2013 white QX-56 then you would only qualify for the re-paint if your at the end of your factory warranty (4 years) the extended warranty (4 years) so your 2011 QX warranty with the re-paint extended warranty would have expired in 2019 which means that only cars, probably early 2012 models, would qualify for the repaint. So even though the settlement said 2009 -2012 Infiniti is not going to be willing to re-paint the cars with over 8 years of warranty coverage from the date of manufacture. For a 2009 that would be 2017 when the time ran out for them. I am waiting to hear from the suit administrator. info@vehiclepaintsettlement.com> Good Luck…
