Infiniti dealership logo standNissan was hit with a class action alleging a serious defect in Infiniti brand vehicles causes the paint to delaminate and peel.

Lead plaintiff John Anglin alleges in his class action lawsuit that Nissan uses severely defective paint on Infiniti vehicles that not only peels, but can also cause rust and other damage to the vehicles’ metal body.

Further, says the plaintiff, the damage often occurs after the warranty period on the vehicle expires and Nissan refuses to fix the damage.

Anglin alleges that he purchased a white 2011 Infiniti at a dealership that cost nearly $73,000. However, shortly after his purchase in 2016, the paint began peeling, so much so that, according to the plaintiff, his vehicle looked grey. The plaintiff says he told both the dealership and Nissan about the problem, but they refused to do anything about it.

“Unlike tires, batteries, and engine oil, which need regular replacement, in modern vehicles, particularly luxury vehicles, automobile paint is expected to last the lifetime of the vehicle, such that, absent an accident, a vehicle owner reasonably would not expect to have to spend thousands of dollars to have their vehicle stripped and repainted during the ownership of the car,” alleges the Nissan class action complaint.

According to the class action, Infiniti vehicles are marketed as luxury cars and owners “receive ‘an unprecedented commitment to professionalism and customer service that is tailored to fit you and your individual needs,’” per Nissan marketing. At the time of manufacture, alleges the plaintiff, the factory applied defective paint; however, the defect was latent and not apparent to consumers when they decided to purchase an Infiniti.

The plaintiff alleges that Nissan is aware of the latent defect in the paint and has been subject to numerous customer complaints. Even while the plaintiff was contacting the dealership and Nissan customer service, continues the plaintiff, Nissan was aware of the problem, but denied it and refused to help Infiniti owners affected by the peeling paint.

“The paint on Plaintiff’s vehicle, as well as other Infiniti brand vehicles purchased by consumers, did not conform to industry standards, particularly given the luxury status and relatively new age of the vehicle,” alleges the complaint.

The plaintiff seeks to represent a nationwide Class of consumers who purchased new Nissan Infiniti brand vehicles with defective paint, along with an Illinois subclass. The class action lawsuit alleges that Nissan was negligent, violated the Magnuson-Moss Warranty Act, breached implied warranties and contracts, and violated Illinois consumer protection laws.

The class action lawsuit is seeking damages, a constructive trust against Nissan on behalf of the proposed Class, and an injunction from selling vehicles with defective paint along with attorneys’ fees.

    I have a white 2012 Infiniti that the paint just peel up and the wind blow it off driving or sitting still and from all the storms and rain I have a portion began to rust I was never received a notice about the paint issue Can I please reopen this claim in s class action lawsuit.

    I have a pearl white Nissan Quest 2012, which was purchased brand new at Nissan of Escondido Dealership in California and have approximately 45,000 miles on it. The paint started bubbling at the upper corners of the lift gate/trunk, which started early 2019. Now the paint is starting to peel severely at the rooftop and crossbars. I’m so disappointed because I take such good care of my van. Can’t believe how much I have to pay for this van with all the upgrades and I haven’t fully enjoyed it and yet it’s already deteriorating. I’ve never experienced such poor paint issues with any of my previous cars. Please help. I’d be more than happy to assist in any way possible for a class action lawsuit.

      I have a nissan frontier 2018 the white paint is peeling off and every frontier I’ve seen is doing the same thing in the same places. Is anyone working on a class action suit

    I have a pearl white 2012 Quest LE that started having paint issues back in 2018. I paid $600 to have the rear hatch repainted. (A huge piece of paint bubbled around the nissan emblem and popped off.) Now the entire roof is peeling and large sections of paint are flying off. The entire roof is nearly exposed and it will cost $2k to repaint the roof. Every professional autobody person I know has said this is defective paint and should have never happen to my van. Now as I drive around and see other nissan quests in white paint having similar problems I’m upset. Nissan should fix this for all who are having this problem. Original owner. Love this van otherwise. Please help!

    I have a Nissan Rogue 2013 (red) with the clear coat peeling off around much of the car. I noticed it early 2020; car has low mileague. Never had a problem with Nissan paint before. Would appreciate knowing if there is any compensation for this. The dealer I bought it from closed a few years ago. Trying another dealer this week to see what they say.

      Did you ever get a response? I have a red 2016 Nissan with low mileage as well. Why is it only a settlement for white paint?!

    I have a Nissan Armada 2009. We started having paint issues around 2014. We bought it to Nissan Dealer’s attention and were told it is “Normal Wear and Tear and not covered under warranty.

    Is there any restitution? We are a family of Nissan owners and have come to realize this is not an isolated issue.

    I have a pearl white(Moonlight White??) 2014 Infinity QX80 that’s paint has started to peel above the windshield. Is this a typical thing for the QX 80? I see the QX56 has issues but nothing on the 80. Any info would be appreciated.

    I got my 2017 Nissan Altima in 2018. The entire lower front end is peeling like crazy straight across.

    I guess we need a class action suit for all Nissan vehicles because it seems everyone is complaining.

    My 2008 infiniti Q56 black paint is faiding really bad on the entire hood and on the top of vehicle by the sun roof looks awful there really should be a recall of some sort this is a serious problem.

      My 2009 Altima Coupe peeling on my hood , roof and trunk. and Nissan said that because the vehicle is out of warranty they denied my claim. How do I join a class action law suit?
