NFL+ subscription class action lawsuit overview:

  • Who: Ryan Oyler filed a class action lawsuit against NFL Enterprises LLC.
  • Why: Oyler claims the NFL auto-converted and auto-renewed its GamePass subscribers to its new NFL+ service without their knowledge or consent while simultaneously charging them for an annual membership.
  • Where: The class action lawsuit was filed in New York federal court.

NFL Enterprises LLC auto-converted and auto-renewed its GamePass subscribers to its new NFL+ service without their “clear knowledge or consent,” a new class action lawsuit alleges.

Plaintiff Ryan Oyler claims the NFL charged GamePass subscribers for a yearlong membership with NFL+ and also auto-renewed and auto-converted their subscriptions to the NFL streaming service.

The NFL then “utilized sophisticated and manipulative design and interface practices” to thwart Oyler’s efforts to cancel the service and prevent “any charges to his payment method,” the NFL class action states.

Upon discovering that the NFL auto-converted his GamePass subscription to an NFL+ subscription, Oyler claims he removed his subscription and payment information from his account but ended up being charged anyway.

“Defendant retained the ability to charge him even though he specifically and successfully acted to prevent this,” the NFL class action states.

NFL class action plaintiff did not receive email confirming account cancellation

Oyler argues the NFL must have failed to remove his payment and account information from its backend systems despite him taking it down his payment method prior to him deleting his account entirely, according to the NFL class action lawsuit.

Further, Oyler claims he never received a confirmation email after getting rid of his account, something he argues is a method used to prevent subscribers from proving when they canceled and when.

“The purpose of not providing a confirmation email is to avoid the customer retaining a record indicating when they cancelled and having proof in the likely event the company continues to charge them,” the NFL class action states.

Oyler claims the NFL is guilty of unjust enrichment, conversion and fraud and in violation of New York General Business Law, the Florida Deceptive and Unfair Trade Practices Act and several state consumer fraud acts.

Oyler demands a jury trial and requests declaratory relief along with an award of monetary, statutory and/or punitive damages for himself and all class members. He wants to represent a Florida and New York class and consumer fraud multistate class of individuals who had their NFL GamePass subscriptions switched to an NFL+ subscription.

In other NFL news, earlier this month, Brian Flores, the former Miami Dolphins head coach, asked a federal judge in Florida to deny the NFL’s request to compel arbitration for his claims that racial discrimination is systemic in the league.

The NFL+ subscription class action lawsuit is Oyler v. NFL Enterprises LLC, Case No. 1:22-cv-08413, in the U.S. District Court for the Southern District of New York.

This shady service has collected $100 from thousands of people. And now in the middle of the season is seemingly cancelled people’s services with no explanation or refund. Any attempt to resolve it leads to a circular creation of service tickets that resolve nothing. I would like to be added to any class action suit against this sham of a service
